BOARD OF SUPERVISORS
Minutes April 15, 2002, 8:30 a.m.
The administrative meeting of the Board of Supervisors, held in the Township Building, was called to order at 8:45 am. In attendance were: Supervisors Ken Miller, Claire Quinn, and Zoë Perkins; also in attendance were Township Manager, Allen Heist; Code Enforcement Officer, Robert Wideman; Township Engineer, Craig Kologie; and Township Planning Solicitor, Fronefield Crawford. Camp Hill Village Group Home @ St. Matthews & Flint Road Penrose Property/Beaver Hill Road Land Preservation Along French Creek: Anne Orth, of the French and Pickering Creeks Conservation Trust advised the Trust has applied to the County and State for $395,000 in funding. They have received a grant for $197,500 plus an additional $16,000 for the cost of acquiring the easement. The Trust is offering $375,000 and it has been accepted. They are looking to finalize the documents this week with the owner to purchase an option to buy the easement. The Trust was hoping to tap into the $85,000 commitment from West Vincent that was previously made in 1997 with an extension. They would like a commitment from the Township to provide that funding by January 31, 2003 in order to complete the project by then. Supervisor Perkins inquired as to whether this totally extinguishes all building rights on property, and Ms. Orth replied in the affirmative. Township Manager Heist asked how much of the 52 acres is outside the easement. Mr. Orth replied between 4 to 5 acres, and added that a survey is being conducted. Supervisor Miller asked if the property bordered a dirt road. The response was yes, but it is very steeply sloped. Supervisor Miller also asked how many buildings could have been developed and the answer was around 18. It was noted that monies had been set aside allowing the Board to approve a particular project that has to be located in West Vincent Township. It was suggested that Tom Piotrowicz be contacted with regard to his adjoining property and whether he would donate, or be interested in selling the right of way or granting an easement. Township Manager Heist noted that the $85,000 could be put off to next year's budget. The matter of the $85,000 is to be put on the agenda for Monday night's (22nd) Board of Supervisor's meeting for a vote. Regarding French Creek trail, Ms. Orth further advised the Board that they have also received County funding and funding from DCNR for feasibility studies, which could cost $25,000. Witek/Fasel Subdivision/Greenway-Lot 2 and 3: Mr. Witek appeared before the Board to advise his interest in constructing a run-in shed on lot 2 of the property within the greenway area. He noted that the barn would be set back on lot 2 and the house is built on lot 3. The structure would be about 10/20 feet and the run-in shed would be open on one side. It was suggested that Mr. Witek explore combining the lots for various tax purposes, and he said he would return to the Board at a later date with a final plan. The Board did indicate to him that they would probably have no problem with a run-in shed as he proposed. Ganzi Property: Joe Conti appeared before the Board to request a reduction in the ten-foot setback to six feet in order to accommodate the already constructed driveway. Mr. Ganzi and his son are the two landowners involved, and both are in agreement with this solution. The Board requested a letter signed by both parties indicating such agreement. Mr. Conti said he would secure such a letter and submit it to the Board. Supervisor Perkins moved to reduce the driveway setback from ten feet to six feet contingent upon receipt of the letter indicating agreement signed by Messrs. Ganzi. Supervisor Quinn seconded the motion, a vote was taken, and the motion was unanimously carried. Castle Valley/Ewing Tract: Craig Kologie placed several maps before the Board and addressed wastewater proposals regarding this tract. It was noted that Upper Uwchlan has indicated that they would take Ewing wastewater. The Board indicated they couldn't do anything further on the plan until they have a signature on the planning module from Upper Uwchlan. Hankin/Pump & Haul: Castle Valley will recommend approval of the pump and haul agreement once all issues are addressed. Chester Springs Road Turnback: Supervisor Perkins made a motion for the Township to accept the turnback from the State of Art School/South Chester Springs Road. Supervisor Quinn seconded the motion, a vote was taken and the motion carried unanimously. Duffield: Allen Heist will address a letter to the proper parties regarding the payment of this engineering bill. COPS Grant: The Board considered information provided by Chief Swininger on federal grant funds being offered by the Department of Justice. He asked the Board's approval to apply on behalf of the Township for a share of this funding. The Board said they saw no problem in applying, and agreed to allow Chief Swininger to file application. ORJ ROTC Community Service Projects: Township Manager Heist advised that David Gottier had inquired as to whether there were any projects with which the ROTC might assist the Township. The projects would be similar to those in which Eagle Scouts had performed in the past. The Board agreed that if Mr. Gottier is involved in oversight of the work, and if there were no liability involved on the part of the Township, it would be possible that a project could be found. Allen Heist will check with counsel regarding the liability issue. Treasurer's Report: The report not submitted at the April 8 p.m. session due to illness, was submitted.
