BOARD OF SUPERVISORS
MINUTES -- NOVEMBER 12, 2001
The
regular meeting of the West Vincent Township Board of Supervisors was held on
the above date at the Township Building. Chairman Kenneth Miller called the
meeting to order at 7:40 p.m.; others in attendance were Supervisors Karl
Brachwitz and Zoë Perkins, Township Manager Allen Heist, and Township Solicitor
Allan Greenwood. Bid
Award: 2001-2001
Snow and Ice Removal Bids were received at the November 5, 2001 administrative meeting. The
Township Manager Allen Heist and the Road Master Kenneth Miller reviewed all
the bids. A motion was made by Mrs. Perkins, second by Mr. Brachwitz to except
D & L Fleck Paving and Excavating Inc. and R.E. Lester, Inc. with David J.
Monteith as a back up when needed. The motion carried unanimously. Unanimous
approval was granted for minutes of October 1,8,15 (Administrative),
15(Conditional Use), 22 and 29 upon a motion from Mr. Brachwitz and second from
Mrs. Perkins. Reports: Treasurer's
Report -
The following October 31, 2001 account balances were reported: General Fund,
$87,176.21; State Fund $79,288.19; Kimberton Sewer Fund $17,796.13; Township
Building Loan Fund $722,961.43; St. Stephens Greene Sewer Fund $26,397.68; St.
Stephens Water Fund $27,671.12 and Open Space Capital Reserve Fund $19,737.19. Police Report -The Police department responded to 40 calls in October; the State Police handled 86 additional calls. The Department conducted several traffic details at school bus stops on St. Matthews Road and Black Horse Road. Two subjects were arrested in the 1500 block of Hollow Road for the possession of marijuana and related paraphernalia, two adults and two juveniles were arrested for trespassing and criminal mischief on Camp Hill Village property and the theft of construction equipment and a flat bed trailer from the 900 block of Pottstown Pike is under investigation. Solicitor's
Report -
Solicitor Greenwood reported working on the earth moving escrow for
Weatherstone (Hankin Group), Cooks Glen Road issues, Deed of Dedication and
Deed of Easement for Horseshoe Farms has been recorded and Walter Dunning
subdivision lots 4 & 5. Correspondence: The Chester County Parks and
Recreation Department has a series of events, programs and activities planned in 2002 and
2003 to commemorate the 225th anniversary of the Revolutionary War in
southeastern Pennsylvania plus sections of Maryland, Delaware and New Jersey. PECO
Energy sent
out a fact sheet regarding the Chester County Electric Distribution System
Upgrades to provide members of the community with current information about
upgrades to the system in our area. Chester
County Emergency Management Coordinators sent information that will be useful in answering
questions about Nuclear Power Plant security and Aircraft issues. Curt Weldon
of the Seventh Congressional District will hold two public forums so that he
may discuss with the community the activities of our government since the
attack on September 11, 2001. A
drought watch and warning has been declared, a letter from the Pennsylvania
Department of Environmental Protection has been received reminding all of
us about the reduction of water use through voluntary measures. Mrs. Perkins
asked whether the St. Stephens Greene and Wetherill Estates will be notified. The
Flowing Springs Road culvert was moved up on the agenda with everyone's approval. Marilee
Ward presented a letter from Thomas E. Boothby, Associate Professor of
Architectural Engineering at Penn State. Mrs. Ward would like to see the
culvert repaired and saved. Kenny Carroll, Christopher Jones, Bruce Sanders
spoke on behalf of the historic value of this culvert. The board has gotten an
estimate from the Township engineer and they will review Mr. Boothby's letter.
Susan Morse would like to see an article in the next newsletter informing the
Township residents of the Mill structure and its culvert. No final discussion
was made at this time. Subdivision/Land
Development/Zoning: The
Board unanimously acknowledges receipt of a subdivision extension agreement for
939 Pottstown Pike extending review time to January 28, 2002 upon a
motion from Mr. Brachwitz and seconded by Mrs. Perkins. Rick
Guarini of the Hankin Group and Elizabeth Witmer, Esquire were present
to ask the Board to have Castle Valley, Inc. finish their review of the
Earthmoving agreement so they may proceed with Final Plan approval. Township
Manager Allen Heist will call Castle Valley. They have asked Allan Greenwood to
review the Homeowners documentation and the escrow agreements. David
Beideman was here on behalf of Mr. Walter Dunning to ask for final plan
approval. It was moved that the Dunning
Subdivision application including waiver of the sewer and water feasibility
report in exchange for which the developer will utilize Best Management
Practices and Stormwater Recharge and a waiver of fee in lieu provisions, be
approved subject to the following conditions, 1) Compliance with the terms and
conditions of the letter of the Township Solicitor to the Township Manager
dated 11/12/01, 2) Compliance with Township Engineer's report of 8/14/01
regarding SLDO section 606, 607, 608 and 609. Upon a motion by Mr. Brachwitz
seconded by Mrs. Perkins. All in favor. The Board unanimously acknowledged receipt of a subdivision extension agreement for the Edwina-Upson
Dunworth and Pauline Davis extending review time to November 26, 2001. Upon
a motion from Mr. Brachwitz and seconded from Mrs. Perkins. Ray Gamble of Toll Brothers, Inc and representatives
for Toll Brothers, Inc and Orleans Home
Builders were present to ask the Board of Supervisions for feedback on
design and waiver issues. Mrs. Perkins explained that they have to get
recommendation from the Planning Commission, which has been holding work
sessions on the second Thursday of each month just for the review of Toll
Brothers (Ewing). Ann Orth, the director of Land Preservation, was
present on behalf of the French and
Pickering Creeks Conservation Trust, Inc. to ask the Board of Superiors to
extend the "the Dirt Road" funds for another eighteen (18) months.
The Trust is waiting for funding to acquire the missing linkages for the 10 +
mile section of the French Creek Trail. A motion was made by Mrs. Perkins to
extend the funding for eighteen (18) months seconded by Mr. Miller, Mr. Brachwitz apposed. Solicitor Allan Greenwood will transfer the lien
that is on a property on Pughtown Road to the current owners with a motion from
the Board and will file a new municipal claim. A motion was made by Mrs.
Perkins and seconded by Mr. Brachwitz. All in favor. Striping of Route 100 & 401 was awarded to State
Line Contractors at $500.00. The seal coating of the basketball court and the
walking path at the Township Park was put on hold until spring. A motion was
made by Mr. Brachwitz, seconded by Mrs. Perkins. All in favor. An executive session will be held immediately
following the regular meeting to discuss personnel matters (Police). Bills List: Mr. Brachwitz made a motion to pay the bills on the
bills list dated November 12, 2001 Mr. Miller would like to review the bill for
Bryon R. Law. This will be discussed at a further date. His regular bill is
approved it was seconded by Mrs. Perkins. All in favor. There
being no further business, Mr. Brachwitz moved that the meeting be adjourned;
the motion was seconded by Mrs. Perkins and the meeting adjourned at 10:25 p.m. Respectfully Submitted, |
