The administrative meeting of the Board of Supervisors, held in the Township Building was called to order at 8:12 a.m. by Chairman Kenneth Miller; also in attendance were Supervisor Zoë Perkins, Township Manager Allen Heist, and Township Solicitor Allan Greenwood. As requested by the Board, Richard Guarini of The Hankin Group submitted a cost estimate from Allan A. Meyers for Westover Lane and Fellowship Road improvements totaling $177,617.75.
Mr. Guarini and John Snyder, Esquire were present to discuss proceeding with earthwork activity on The Hankin Tract (Weatherstone Subdivision Plan) before final plan approval and the escrow is in place. Mr. Snyder indicated that completion of improvements prior to final plan approval is common procedure throughout the State and in compliance with the MPC; the Township has no grading permit requirement or ordinance, and according to the Township Subdivision and Land Development Ordinance grading may begin upon receipt of proper permits (Chester County Conservation District and DEP). Solicitor Greenwood voiced concern regarding potential risk to the Township in the event work is deficient and Township action is necessary. A lengthy discussion resulted in the following:
Mrs. Perkins and Mr. Miller indicated a non-binding favorable inclination to accept the above terms. Mr. Snyder will draft an agreement for review; the issue was tabled until the November 5th administrative meeting.
Both Manager Heist and Mr. Miller had heard that The Hankin Group is contemplating a Community Farm within the Open Space Area in the vicinity of Fellowship Road and Conestoga Road, which is to be dedicated to the Township. Mr. Guarini confirmed that Mr. Hankin has participated in discussions regarding Community Supported Agriculture; the Board’s initial response was opposition to the use, expressing a desire to maintain the area as open space and requested that Mr. Hankin meet with them to discuss the issue further.
Castle Valley Consultants, Inc. is in the process of reviewing the status of Matthews Meadows Subdivision punchlist items.
Manager Heist reported on his recent discussions with PEMA/FEMA regarding the Flowing Springs Road Bridge. Klein and Hoffman, Inc. will proceed with the bid specifications, separating the bid for various line items, and advertising the bid for bridge repair as soon as possible. In the meantime, Manager Heist will prepare an appeal of PEMA/FEMA’s rejection of the scope of work pertaining to "hidden damages" (work not noted during the initial bridge project inspection) totaling $9150 and "scour protection" (improvement work, not related to the structural safety of the bridge) totaling $32,000.
The Township is waiting to receive an agreement and permit application from Philadelphia Suburban Water Company regarding the installation of a water line along Cedar Lane and the paving of Cedar Lane prior to vacation.
A full version of the Township Zoning Ordinance amendments will be submitted to the Board at the Monday, November 5th administrative meeting; a public hearing is scheduled for December 10, 2001.
The 2002 General Fund Expenditures Budget was distributed to Board members for review.
Manager Heist will get cost estimates for sealing the Township Park basketball court and walking trail; Castle Valley Consultants, Inc. will be asked to submit bid specifications.
Mrs. Perkins reported that the Township Newsletter would be mailed this week.
