BOARD OF SUPERVISORS
MINUTES -- MONDAY, OCTOBER 22, 2001

The regular meeting of the West Vincent Township Board of Supervisors was held on the above date at the Township Building.  Chairman Kenneth Miller called the meeting to order at 7:35 p.m.; others in attendance were Supervisors Karl Brachwitz and Zoë Perkins, Township Manager Allen Heist, and Township Solicitor Allan Greenwood.

Correspondence:

Emergency Management Director David Monteith advised the Board that the 2001 Limerick Drill scheduled for November 1st has been postponed to April 2002.

 

Subdivision/Land Development/Zoning:

A motion was made by Mrs. Perkins, seconded by Mr. Brachwitz, to accept the Gary and Katherine Spohn, equitable owner/Pauline A. Davis, owner lot line change plan as a non-building lot subdivision and forward the Form B-Request for Non-Building Waiver to DEP; the motion carried unanimously.

 

An application to the Zoning Hearing Board was received from Edward and Lisa Quinn, 1066 Bartlett Lane, requesting a special exception pursuant to the terms of Section 603.C.2 of the Township Zoning Ordinance to use their property for educational purposes; no hearing date has been set.

 

Since a representative was not present, discussion on ordinance relief and waiver requests pertaining to the 939 Pottstown Pike Land Development Plan was tabled.

 

The Board unanimously acknowledged receipt of a subdivision extension agreement for Weatherstone extending review time to November 30, 2001 upon a motion from Mr. Brachwitz and second from Mrs. Perkins.

 

Richard Guarini of The Hankin Group and Elizabeth Witmer, Esquire were present to report to the Board that a form of Escrow Development Agreement has been received and all conditions for final Weatherstone Preliminary Plan approval have been met, contingent upon the Township Engineer’s review of E. B. Walsh & Associates, Inc. letter dated October 22, 2001.  To address the proposed perimeter trail on the Bailey Farmstead, a note will be added to the final plan stating that prior to the Township accepting dedication of the open space, volunteer groups are permitted access to re-establish and/or mark the equestrian/pedestrian trail along the perimeter of the Bailey Farmstead (adjacent to the Ominsky/Heinz, Markle, and Archinal properties).

 

Mr. Guarini asked that a Pre-Construction Meeting be scheduled and advised the Board that installation of silt fence, some earthwork activity, and mowing have begun on the Hankin Tract; Chester County Conservation District approval has been received and grading will begin upon receipt of the NPDES permit.  Solicitor Greenwood voiced concern regarding potential risk to the Township if grading begins before the escrow is in place in the event the work is done incorrectly, creating drainage problems for neighboring properties, and the developer is not available or unable financially to correct the problem resulting in the expenditure of Township funds.  Ms. Witmer pointed out that the Township has no grading permit requirement or ordinance and according to the Subdivision and Land Development Ordinance grading may proceed upon receipt of proper permits (Chester County Conservation District and DEP).  Ms. Witmer will submit a letter detailing Hankin’s position and the issue was tabled until the Monday, October 29th administrative meeting.  Mr. Guarini agreed not to proceed with earthwork prior to the October 29th meeting.         

 

Castle Valley Consultants, Inc. submitted Westover Lane and Fellowship Road re-construction options for review; Mr. Guarini will prepare cost estimates for the October 29th administrative meeting.

 

As a follow-up to conversations with Richard Morton, Esquire, Solicitor Greenwood reported the punchlist status for Matthews Meadows Subdivision as follows:

  • The grading work has been completed.
  • Paving work has been completed.
  • Sealing of the walking path has been completed.
  • A plan addressing the Daniel Drive "weep/seep" problem has been submitted to Castle Valley Consultants for review.
  • A design to complete the emergency spillway has been submitted to Castle Valley Consultants for review.
  • An actual count of the landscaping, compared to the Township Engineer’s calculation of the number of plantings required by the approved plans, has been submitted.

The above list is subject to the Township Engineer’s verification.  A summary sheet for the remaining escrow monies was received from Castle Valley Consultants, Inc. 

 

A Notice of Violation in connection with the Matthews Meadows Sewage Treatment Plant was received from PA DEP stating that Discharge Monitoring Reports for May through August have not been submitted as required by the Water Quality Management permit.  The developer’s operator has indicated that the monitoring reports were sent when they were supposed to be sent and believes that there may be some problem with the receipt or filing of the reports by DEP.  The operator will be sending new copies of each report to DEP.  

 

John Bachich, Woodstone Development Company, was present to discuss the Stonecroft Pump and Haul Agreement.  It was agreed $3200 would be paid to the Township by the Developer before each U&O permit is issued and the Escrow Agreement would be amended by the Township, the Developer, and the Bank to make clear that the escrow could be used by the Township to pay for the pump and haul.  Mr. Bachich indicated that construction of the sewer plant is under way and completion is projected for February or March 2002.  Solicitor Greenwood has prepared a revised Pump and Haul Agreement for review by the Developer and his attorney.

 

Notification of the Toll Brothers, Inc. and Orleans Homebuilders, Inc. proposed subdivision on the Ewing Tract, South Chester Springs Road and Eagle Farms Road will be sent to property owners within 500’ of the two properties on Davis Lane transferring development rights to the site.

 

Old Business:

South Chester Springs Road residents Bob McDevitt, Tim Riddle, Gloria Shontz, and Tom Skahill presented a petition to the Board of Supervisors requesting the developer of the Ewing Tract to terminate South Chester Springs Road at Eagle Farms Road for the following reasons:

  • The "quaint" but primitive rural passage could not safely support the additional traffic from a large development.  Road improvements would be costly and irreparably damage its classic qualities.
  • The development plans already incorporate major traffic improvements including the relocation and improvement of the existing Eagle Farms Road providing access to either end of Byers Road, along with new access to both Fellowship Road as well as the future Eagle bypass.
  • No improvement of South Chester Springs Road is sought, planned, or anticipated.
  • Maintain the quality of life.

Consideration was also requested regarding the following:

  • Development of a cul-de-sac or similar provision to enable traffic to safely turn around at the new termination.
  • Bridal trail access, pedestrian or bicycle paths as appropriate.
  • Emergency vehicle egress, as required.
  • Requiring the developers to maintain much of the old growth forest and restrict clear cutting.
  • Closure of South Chester Springs Road would be a small measure of compensation for the loss to the neighborhood as a result of the Ewing Tract’s TDR Receiving Zone designation.

The petition was signed by Timothy and Joan Riddle, Mildred and Robert MacBurney, Ann and Ronald Brostrom, James and Marge Kenney, Mary and Gary Spellman, William and Janice Isenberg, Taylor Braendel, Richard Merrick, Anthony and Janet Ciarlone, Derial and Gail Sanders, Gloria Shontz, Margaret Gerhard, Matt and Mary Shafer, Robert and Kathryn McDevitt, and Thomas and Geraldine Skahill and will be forwarded to the Planning Commission and EAC for consideration.

 

Manager Heist received a complaint regarding the condition of St. Andrews Road; Mr. Miller indicated that the Road Crew is planning to re-grade and possibly use a roller on the roadway.  Manager Heist will contact the Cantrell family regarding the status of the re-alignment project proposed for St. Andrews Road.

 

Mr. Miller has received requests for dust control application on Dewees Lane, St. Andrews Lane, Hilltop Road, and Black Horse Road; the budget will be reviewed.

 

Mr. Miller and Mrs. Perkins indicated willingness for West Vincent Township to share in consultant/facilitator costs associated with creating an intermunicipal agreement for the Regional Planning Group (consisting of the Boroughs of Phoenixville and Spring City, and Schuylkill Township, East Pikeland Township, Charlestown Township, East Vincent Township, and West Vincent Township) at an estimated cost of $800-$1500 per Borough and Township.  The next Regional Planning Meeting will be held Wednesday, October 24, 2001.   

 

A Township resident contacted Mrs. Perkins regarding the Township’s support of French and Pickering Creeks Conservation Trust’s application for Chester County Landscapes 21st Century Fund Trails Grant.  If awarded, the Grant will provide funds to purchase trail easements on multiple properties along the French Creek; the trail would provide public access for non-motorized forms of travel including hiking and horseback riding.  The resident voiced concerns regarding restricting public access onto his property.  The Township Manager will look into the status of the Grant application.

 

Manager Heist will contact PEMA regarding the status of their review of bid documentation for the repair of Flowing Springs Road Bridge; the issue was tabled to the October 29th administrative meeting agenda.  Mr. Miller indicated that the pipe and concrete endwalls for the Flowing Springs Road culvert has been ordered.  Mrs. Perkins advised that Marilee Ward has been working on obtaining funds to replace the stone arch; the Board will put a hold on the culvert repairs until November 15th.  Mr. Miller will contact Mrs. Ward regarding the time frame for culvert repairs.

 

New Business:

Notice was received from Aqua-Niche advising of a Kimberton Stream restoration project on the Douglas property. 

 

Signal Service Inc. recently completed their preventive maintenance inspection of the Routes 100 and 401 intersection.  The Road Crew will take care of signage issues; Manager Heist will get estimates for repainting the stop bars and crosswalks at the intersection and lines on the basketball court at the Township Park.      

 

Jim Dewees of the Patriot Order of Sons of America has offered to install a flagpole and flag at the Township Park; as a result of preliminary discussion regarding lighting and maintenance, the issue was tabled until the Township Building relocates to the Evans property. 

 

Business from the Floor:

West Pikeland resident John Barnett thanked the Board for sending him notification of meetings pertaining to the proposed subdivision on the Ewing Tract; all property owners within 500’ of the proposed development received notification.

 

Bills List:

Mr. Brachwitz made a motion to pay the bills on the Bills List dated October 22, 2001; it was seconded by Mrs. Perkins and carried unanimously.

 

There being no further business, Mr. Brachwitz moved to adjourn the meeting; the motion was seconded by Mrs. Perkins and the meeting adjourned at 9:20 p.m.
