CONDITIONAL USE HEARING
MINUTES -- MONDAY, OCTOBER 15, 2001

A conditional use hearing to consider the application of Toll Brothers, Inc. and Orleans Homebuilders, Inc. was held on the above date at the Township Building.  Vice Chairman Karl Brachwitz called the public hearing to order at 7:35 p.m.; others in attendance were Supervisor Zoë Perkins, Township Manager Allen Heist, Solicitor Richard Morton, Mark Hagerty, court reporter and Christopher P. Luning, Esquire, representing the applicants.

The purpose of the hearing was to take formal action on the application of a conditional use permitted under Section 1704.B.1.d of the West Vincent Township Zoning Ordinance to regrade within certain areas of precautionary steep slopes, creating areas of cuts and fills, in conjunction with the proposed development of the Ewing Tract, located at Eagle Farms Road and Chester Springs Road in the R-3 Zoning District.  However, a letter dated October 3, 2001, amended the Application to include, in addition to the approval already requested, a request for relief pursuant to Section 1704.B.2 and Section 2306 of the Township Zoning Ordinance pertaining to construction or improvements within High Ground Water Areas.

 

Christopher Luning, Esquire, advised the Board that notice of the hearing and amended Application was provided to all property owners within 500 feet of the Ewing Tract and requested that the hearing be continued until November 19, 2001 to allow time for review of the supplemental information/documentation and address Planning Commission comments.  Mr. Luning offered three Applicant exhibits for the record as follows:

 

           Exhibit A-1       Agreement of Sale

           Exhibit A-2       Christopher P. Luning Correspondence to West Vincent Township dated October 3, 2001

           Exhibit A-3       Notification of Property Owners within 500’ of the Ewing Tract

 

Mr. Luning will work with Township Planning Solicitor Fronefield Crawford on advertisement of the amended conditional use application and will send notification to neighboring property owners.  Township resident Harry Griendling requested that copies of the Applicants’ exhibits be included in the notification; Mr. Luning agreed to include Exhibits A-1 and A-2, however Exhibit A-3 would not be included due to the number of pages involved.

 

Township resident Jill Cochran asked if an opportunity would be given tonight for entering party status.  Solicitor Morton indicated an invitation for submission of Entry of Appearance forms would be given on November 19th.

 

The conditional use hearing in connection with the application of Toll Brothers Inc. and Orleans Homebuilders, Inc. was continued to Monday, November 19, 2001 at 7:30 p.m. at the West Vincent Township Building; the hearing was adjourned at 7:45 p.m.
