The regular meeting of the West Vincent Township Board of Supervisors was held on the above date at the Township Building. Chairman Kenneth Miller called the meeting to order at 7:38 p.m.; others in attendance were Supervisors Karl Brachwitz and Zoë Perkins, Township Manager Allen Heist, and Township Solicitor Allan Greenwood. Subdivision/Land Development/Zoning: A motion was made by Mrs. Perkins to grant final approval for the Francis Vance Subdivision (lot line change) Plan and approval of the DEP Form B waiver of sewage facilities planning requirements; the motion was seconded by Mr. Brachwitz and carried unanimously.
John Bachich, Woodstone Development Company, was present to request final conditional approval for the Stonecroft Subdivision Plan (a.k.a. Laymen’s Home Missionary Movement/Woodstone/The Preserve at Birchrun). Solicitor Greenwood stated that he has been working with Mr. Bachich’s attorney and overall is satisfied with the form of the agreements. Mr. Bachich will forward a copy of contractor bid prices to the Township Engineer for the escrow account spread sheet. A motion was made by Mrs. Perkins to grant final approval for the Stonecroft Subdivision Plan conditioned upon the following:
1. The Developer will finalize the Land Development Escrow Agreement, subject to the satisfactory review of the Township Solicitor, and submit the agreement to the Township with the necessary financial security; 2. The Developer will finalize the Declaration of Covenants, subject to the satisfactory review of the Township Solicitor; 3. Receipt of the Pennsylvania Department of Environmental Protection Part II Water Quality Permit for the sewage facilities.
The motion was seconded by Mr. Brachwitz and carried unanimously.
The West Vincent Township Zoning Hearing Board will consider the application of Hoffman and Levin Partnership requesting zoning relief from the 100-foot setback requirement for buildings with overnight accommodations for animals on Wednesday, June 20, 2001 at 7:00 p.m.
Old Business: Solicitor Greenwood reviewed Ordinance No. 108-2001, as advertised in the Daily Local News on May 18, 2001, defining and establishing regulations for the use of Parks and Recreational Facilities in and/or owned by the Township; fixing the hours of their use; prohibiting certain conduct therein; requiring reservations for specific uses; authorizing additional regulations and the closing of facilities under certain circumstances; permitting fishing under the applicable Laws of the Commonwealth; designating enforcement officer; and prescribing penalties for violation. A motion was made by Mr. Brachwitz, seconded by Mrs. Perkins, to adopt Ordinance No. 108-2001; the motion carried unanimously. It was noted by Board members that the ordinance does not address horseback riding regulations; if necessary, the issue will be addressed in the future.
Solicitor Greenwood reviewed Ordinance No. 109-2001, as advertised in the Daily Local News on May 18, 2001, authorizing regulations during snow and ice emergencies and providing penalties for the violation. A motion was made by Mr. Brachwitz to adopt Ordinance No. 109-2001; the motion was seconded by Mrs. Perkins and carried unanimously.
Notification was received from PennDOT informing the Township that the bid for resurfacing Birchrun Road and St. Matthews Road was scheduled for letting on May 24, 2001 and proceed date is July 23, 2001.
The PA Council on the Arts pass through matching grant to the Chester Springs Studio was received in the amount of $700 ($1,000 was requested); the Board authorized payment to the Studio of the total Township budgeted match of $1,700.
George Keegan questioned the markings on Sheeder Mill Road; no work is planned by the Township at this time.
New Business: Maureen Duey was present to request additional funding of $700 for the Chester Springs Library due to the population increase reflected on the 2000 Census, which is the basis for the Library’s grant applications and contribution rates. A motion was made by Mrs. Perkins, seconded by Mr. Brachwitz, to increase the budgeted contribution amount of $2500 to $3200; the motion carried unanimously. Ms. Duey advised that when the new library facility is completed in West Vincent Township, service territories would be revised.
Correspondence was received from Columbia Gas Transmission Corporation advising of plans to replace the existing pipeline from the compressor station in Eagle to the Downingtown station. Columbia has also filed an application to the Federal Energy Regulatory Commission to construct and operate a 6,000 horsepower compressor unit at the Eagle Compressor Station. Paul Brock, Wyndemere Lake Drive, expressed his concerns regarding noise levels. Mr. Brock has monitored decibel levels of the existing compressor unit, and found the noise levels exceed zoning regulations. Code Enforcement Officer Robert Wideman will follow-up on the proposed compressor unit, review the noise level study conducted by Columbia, and review the Columbia Gas Transmission Corporation Conditional Use Decision. Manager Heist will enter party status to the application proceedings on behalf of the Township, draft a letter commenting on the environmental (noise) impact, and obtain cost estimates to conduct a noise level study.
The Township received a copy of a DEP GP-3 General Permit for bank rehabilitation and protection to prevent erosion on the Calhoon property, 1621 Birchrun Road.
Correspondence was received from PennDOT regarding the proposed resurfacing of Pottstown Pike between Park Road and Prizer Road; the project is scheduled for a Spring 2002 letting.
Business from the Floor: Jason Phillips reported that Upper Uwchlan Township will be contacting the Township regarding the installation of an emergency generator on the west side of Black Horse Road in Upper Uwchlan Township to assist PSW in providing water service to the Hankin Tract.
Roadmaster Kenneth Miller reported that the consistency of the recycled concrete material from low bidder ($7.20/ton) Pottstown Trap Rock Quarries is unacceptable; the Board approved using the secondary bid at $7.35/ton. Also, Mr. Miller is working on a discrepancy in the billing for JMG’s dust suppressant product.
Bills List: Mrs. Perkins made a motion to pay the bills on the Bills List dated May 29, 2001; it was seconded by Mr. Brachwitz and carried unanimously.
There being no further business, Mr. Brachwitz moved the meeting be adjourned; the motion was seconded by Mrs. Perkins and the meeting adjourned at 8:25 p.m.
