BOARD OF SUPERVISORS

MINUTES -- MONDAY, APRIL 23, 2001

 

The regular meeting of the West Vincent Township Board of Supervisors was held on the above date at the Township Building.  Chairman Kenneth Miller called the meeting to order at 7:35 p.m.; others in attendance were Supervisors Karl Brachwitz and Zoë Perkins and Township Solicitor Allan Greenwood.

Correspondence:

A spring Household Hazardous Waste Collection Event will be held May 12th at the Owen J. Roberts High School from 9:00 a.m. to 3:00 p.m.  Acceptable materials include cleaning and maintenance products that are labeled as toxic, flammable, ignitable, corrosive, reactive, caution, warning, danger, or hazardous.

 

The Chester County’s Division of Weights & Measures warns that there are outfits and individuals out there who are scamming people out of their money with suspect debt consolidation and refinancing schemes.

 

PA DEP will host a forum, “Water – Is Our Future Draining Away?” on May 3, 2001 at 7:00 p.m. at the Best Western Hotel in Lionville to discuss issues related to the need for new water resources legislation in Pennsylvania.

 

Subdivision/Land Development/Zoning:

An agreement for subdivision review extension to July 23, 2001 for the Vance Subdivision Plan was acknowledged with a motion from Mrs. Perkins and second from Mr. Brachwitz; the motion carried unanimously.

 

The Board unanimously acknowledged receipt of a subdivision extension agreement for Woodstone Development (Laymen’s Home Missionary Movement) Subdivision Plan extending review time to May 14, 2001 upon a motion from Mr. Brachwitz and second from Mrs. Perkins.

 

The Board unanimously acknowledged receipt of a subdivision extension agreement for The Hankin Tract (By-Right) Subdivision Plan extending review time to May 31, 2001 upon a motion from Mr. Brachwitz and second from Mrs. Perkins.

 

An agreement for subdivision review extension to May 31, 2001 for the Weatherstone Subdivision Plan was acknowledged with a motion from Mr. Brachwitz and second from Mrs. Perkins; the motion carried unanimously.

 

Old Business:

The following three proposals were received to prepare, prime and paint the interior walls of the Evans farmhouse on St. Matthews Road:

Mr. Brachwitz will contact Chris Choiniere to clarify the scope of work; the issue was tabled until the May 14th regular meeting.

 

In response to David Ercole’s request for relief from setback requirements to keep chickens as an accessory use on his property on 1979 Kimberton Road, correspondence was received from neighbors Lauren and Gary Miller asking the Board to deny the request mentioning concerns including noise disturbance, odor, and potential contamination of soil and water.

 

FEMA has approved $13,265 to repair the Flowing Springs Road Bridge; additional Federal funding will be available upon completion of the project.  A motion was made by Mrs. Perkins, seconded by Mr. Brachwitz, to authorize Klein and Hoffman to start the permit application process; the motion carried unanimously. 

 

New Business:

Signal Service Inc. submitted their Traffic Signal Maintenance Contract Renewal; the preventive maintenance and relamping contract cost remains the same as last year, however hourly rates were increased.  Solicitor Greenwood will review the contract and percentage of hourly rate increase; the issue was tabled until the May 14th regular meeting.

 

The Board approved extending PennDOT Permit #06043930 for twelve months to completed drainage and driveway work at the Farmhouse property on St. Matthews Road.

 

To follow-up with non-compliance of an enforcement notice issued regarding the installation of a shed within the front yard and without a building permit on the Cook property, 1676 Sheeder Mill Road, Code Enforcement Officer Robert Wideman requested to proceed with legal action.  A motion was made by Mr. Brachwitz, seconded by Mrs. Perkins, to authorize Robert Wideman to proceed with legal action in regard to the Cook property violation; the motion carried unanimously.

 

Business from the Floor:

In response to a question from Bruce Saunders, an ordinance controlling and regulating hours of minors within public places and controlling and regulating disturbances of the peace, peddling, and littering was adopted at the April 9th meeting; a summary of this ordinance will be included in the next Township newsletter.

 

Mr. Saunders also asked if an initiative has been undertaken for an open space referendum on the November ballot.  The Board has discussed the referendum issue and a decision will be made prior to July.  Mrs. Perkins advised that the West Vincent Land Trust would work towards informing Township residents and publicizing the referendum issue.

 

Solicitor Greenwood reviewed the final documents pertaining to the Jeffrey Duffy Subdivision Plan and found the documentation complete.  A motion was made by Mr. Brachwitz to approve the Escrow Agreement between Jeffrey Duffy and Carol Gaspar and the Township, statement regarding the relocation of the lot line separating Lots 1 and 2 in the Cotswold Subdivision Plan, and Contract Change Order - #1.  The motion was seconded by Mrs. Perkins and carried unanimously. 

 

Bills List:

Mr. Brachwitz made a motion to pay the bills on the Bills List dated April 23, 2001; it was seconded by Mrs. Perkins and carried unanimously.

 

There being no further business, Mrs. Perkins moved that the meeting be adjourned; the motion was seconded by Mr. Brachwitz and the meeting adjourned at 8:15 p.m.
