MINUTES - JULY 31, 2000

The administrative meeting of the Board of Supervisors, held in the Township Building, was called to order at 8:03 a.m. by Chairman Kenneth Miller; also in attendance were Supervisors Karl Brachwitz and Zoë Perkins, Township Manager Allen Heist, and Township Engineers Tom Kelso and Craig Kologie.

Vincent Kling was present to review his three-lot subdivision plan for 36.4 acres on the southeast side of Birchrun Road and Shady Lane and request a waiver from Section 615C of the Subdivision and Land Development Ordinance requiring the reserve of 5,000 square feet of land per dwelling unit for recreational use.  The subdivision plan provides for three large lots - 7.066 acres, 12.599 acres, and 16.696 acres - to be conveyed to Mr. Kling’s children.  A motion was made by Mrs. Perkins, seconded by Mr. Brachwitz, to grant a waiver request from Section 615C of the Subdivision and Land Development Ordinance for the Vincent Kling Preliminary/Final Subdivision Plan dated July 15, 2000; the motion carried unanimously.

A revised draft Sewage Facilities Agreement for The Hankin Tract, has been received and Richard Guarini was present to review the document and request the Board to approve and submit the planning module to PADEP.  Mrs. Perkins moved to authorize submission of the planning module to PADEP with the understanding that a note will be added to the subdivision plan giving the Board authority to withhold building permits if normal maintenance of the system is not performed.  Normal maintenance includes:

  1. Equipment in proper operating condition.
  2. Irrigation fields properly maintained per the approved Crop Management Plan.
  3. Buildings maintained.

The motion was seconded by Mr. Brachwitz and carried unanimously.  The final agreement will be forwarded to the Township Engineer for review prior to submission to PADEP.  The Township plans to conduct monthly inspections of the system.

Paul Fairchild, 43 S. Iroquois Lane (Wetherill Estates), was present to discuss an inadequate drainage situation and sidewalk issue relating to his property.  Mr. Fairchild advised that Southdown Properties would be regrading his property to resolve the drainage situation and requested that the walking trail in front of his property, which will be removed during regrading, be replaced with an extension of the lawn.  Presently, the walking trail terminates on his property; grass would absorb some of the water run-off flowing toward the storm drain; the walking trail, after regrading the front yard, would be at a higher elevation and inclined; and since his property is at the end of a cul-de-sac, snowplows pile snow onto the walking trail rendering the trail useless and becomes a violation to Ordinance 91-1999 addressing snow removal and repair of sidewalks.  Mr. Kelso suggested a rolled concrete curb to aid the drainage problem.  The Township Engineer will inspect the property and make recommendations to the Board.

As a result of recent changes to the PA Municipalities Planning Code (Acts 67 and 68) regarding regional planning and zoning issues, a representative from Newtown Township, Bucks County, has been invited to attend the Planning Commission Workshop on Thursday, September 14th to discuss their experience in implementing these types of land development regulations; Fronefield Crawford will also be invited to attend to discuss Acts 67 and 68.

Manager Heist reported on his meeting with the Chester County Conservation District regarding the Dirt and Gravel Road Program.  Grant applications are available to provide funds to municipalities to repair dirt and gravel roads that are contributing sediment to Special Protection streams.  During an inspection of the Township dirt roads to identify problem areas, it was noted that a pipe may need to be replaced on Jaine Lane in the vicinity of Birchrun Road; Collinson Inc. will be requested to hold on guiderail installation until the pipe replacement is decided.

The Board reviewed correspondence from Taylor Braendel and Larry and Gloria Shontz regarding the Taylor Braendel Conditional Use Decision; the decision will be revised to include "No film or video production shall be permitted on weekend days or on holidays".

A motion was made by Mrs. Perkins, seconded by Mr. Brachwitz, to approve signing The Hankin Tract Settlement Agreement and Order between Morrison Huston, Joseph Vasile, and the Concerned Citizens of West Vincent Township; the Board of Supervisors; and West Vincent Associates, Ltd.  The motion carried unanimously.

There being no further business, the meeting adjourned at 9:50 a.m.
