BOARD OF SUPERVISORS
MINUTES - JULY 17, 2000

The administrative meeting of the Board of Supervisors, held in the Township Building, was called to order at 8:05 a.m. by Chairman Kenneth Miller; also in attendance were Supervisors Karl Brachwitz and Zoë Perkins, and Township Manager Allen Heist.

A motion was made by Mrs. Perkins, seconded by Mr. Brachwitz, to approve signing a Deed of Transfer of Development Rights and Transfer of Development Rights and Restrictive Covenant Agreement pertaining to the Thomas G. Drauschak property (T.P. #25-3-132) on Davis Lane; the motion carried unanimously.

John Bruner, Mary Griffith, Ken Comstock, John Mackey, Ronald Agulnick, Esquire, David Frame, and Steven Siana, Esquire were present to review a draft outline of the road dedication process for the northern segment of the Route 100 By-Pass between Birchrun Road and Nantmeal Road.  Calculation of density bonus was added as item 8 on the outline.  The Board indicated a non-binding general acceptance of the most recent revision of the Route 100 By-Pass Alignment and draft outline; the property owners will proceed with the road dedication process.

Ronald Agulnick, Esquire, representing James Fasel, was present to submit a revised Restrictive Covenants Relating to Transferrable Development Rights Agreement and Deed Restrictions document (consistent with Solicitor Greenwood’s initial review) for the Fasel property and requested the Board to reconsider its previous ruling of July 10th to deny the Fasel Subdivision application.  The Board granted final approval subject upon the Township Solicitor’s review and approval of the TDR Restrictive Covenant Agreement; Mr. Greenwood returns from vacation July 21st.

A representative from Newtown Township, Bucks County has been invited to attend the September 14th Planning Commission Workshop to discuss regional planning and zoning issues as a result of recent revisions to the MPC (Acts 67 and 68).

St. Andrews Episcopal Church and the Exton Chamber of Commerce have requested a link added to the Township website.  The Board’s website policy permits links to government agencies; St. Andrews Episcopal Church and Exton Chamber of Commerce requests were denied.

The Board authorized Code Enforcement Officer Robert Wideman to attend courses regarding wastewater plant operation.

Comments received regarding the draft Sewage Facilities Agreement for The Hankin Tract will be forwarded to the Hankin Group for document revision; the next formal meeting of the Board is July 24th.

The Board reviewed amendments to the Employee Manual including the addition of "Computer Use and E-Mail Policy" and clarification of holiday overtime; the amended Employee Manual will be placed on the July 24th agenda.

Mr. Brachwitz and Manager Heist will meet with the architect on Thursday to review the West Vincent Township Municipal Complex bids.

Manager Heist will be meeting with PennDOT on August 3rd regarding the bridge project on South Chester Springs Road; to date there has not been a response from PennDOT to correspondence from the Township regarding traffic control devices (i.e. warning signs, "No Left Turn" sign, limited access during certain hours, and blinking warning sign/light) on Route 401 and South Chester Springs Road.

The Board approved a revised cost estimate from the Township Traffic Engineer for structural inspection of six Township Bridges in the amount of $6,700.00; Manager Heist mentioned PennDOT does not have the manpower to conduct bridge inspections for cash payment.

The 2000-2001 Consortium Salt bid awarded to Rochez Brothers was approved by the Board.

A response letter to Melissa Bertolami’s formal complaint letter of 6-19-00 declining her request to identify the person who made the alleged statement to Ms. Bertolami during the March 27, 2000 meeting and his name and words entered into the public record of that meeting was reviewed by Board members and approved for signature.  If desired, Ms. Bertolami may pursue private legal rights or remedies.

Cindy Clark, 2601 Flowing Springs Road, reported concerns regarding a number of gypsy moth egg masses on her property; Manager Heist will investigate.
