The regular meeting of the West Vincent Township Board of
Supervisors was held on the above date at the Township Building Chairman Kenneth Miller called the meeting
to order at 7:35 p.m.; others in attendance were Supervisors Karl Brachwitz and
Zoë Perkins, Township Manager Allen Heist, Township Solicitor Allan Greenwood,
and Bill Handy, court reporter.
Thomas M. Keenan, Esquire, representing Mr. and Mrs. Strawbridge, advised the Board of the applicants concerns regarding paragraph eight in the draft decision, which addresses
limitations regarding riding or training lessons. The following limitations are the minimum the applicant could submit to and conduct a successful facility:
- a maximum of two instructors teach a lesson in any hour;
- a maximum of five students participating in any lesson;
- a maximum of eight lessons taught during any day with each lesson being no longer
than two hours
In addition, the Strawbridges
intend to hold clinics for the benefit of their students up to six times a
year.
The Board and applicants discussed the following:
- agreement with the draft regulations regarding the
manure storage pit and disposal;
- agreement with the maximum number of horses as
established in Section 2220A;
- agreement with the draft outdoor area or outdoor arena
lighting regulations;
- agreement with the draft hours of operation (8 a.m. to
7 p.m., excluding emergency care of horses);
- agreed to add to paragraph #8: e. operation not to exceed 25 students per day;
- agreed to additional condition stating: Off street parking shall be provided for all
vehicles involved in the regular operation of the commercial stable and
clinics;
- agreed to additional condition regulating clinics – six
times per calendar year; four sessions per day; five students per session;
- adding a condition regulating the use of portable loudspeakers
(i.e. permitted, permitted indoors, or permitted indoors if inaudible off the
property);
- agreement with the condition that the commercial stable
operation shall commence within two years of the date of this Decision; failure
to commence within this period or cessation of the commercial stable use for a
continuous period of five years shall terminate this conditional use approval;
- the Applicants shall notify the Township of
commencement of the commercial stable operation.

admitted into evidence. There being no
further testimony or questions, the evidentiary portion of the record was
closed; the Board will render a decision on Monday, June 26, 2000. A copy of the draft Decision and
notification of the next hearing date will be sent to Party Robert Kaiser. The conditional use hearing in connection
with the application of Michael and Anne Strawbridge will continue on
Monday, June 26, 2000 at 7:30 p.m. at the West Vincent Township Building;
the hearing was adjourned at 8:20 p.m.
Conditional Use Hearing:
A conditional use hearing for Stephen
W. Harman was called to order at 8:21 p.m. The hearing had been duly advertised as shown by proof of
publication and notice had been given to all property owners within 500’ of the
Harman property. The applicant seeks
permission to place a driveway, septic system, and stormwater management system
within a precautionary slope district under Section 1704 of the West Vincent
Township Zoning Ordinance on his property (Tax Parcel No. 25-4-36.4) located at
4 Half Hill Road in the RC Zoning District.

Chairman Miller asked if anyone
present would like to enter party status; there was no response.
Code Enforcement Officer Robert
Wideman has visited the site, reviewed the design plan prepared by Hopkins and
Scott, Inc. finding the plan adequately addressed the steep slope issues, and
recommends that the Board grant approval conditioned on the driveway being
installed in accordance with the design plan.
A motion was made by Mrs. Perkins
to grant conditional use approval to Stephen W. Harman subject to the
condition that there be compliance with Mr. Wideman’s recommendation that
all particulars are consistent with the design plan prepared by Hopkins and
Scott submitted as Exhibit A-2. The
motion was seconded by Mr. Brachwitz and carried unanimously.
Continuation of Regular
Meeting:
The regular meeting was called to order at 8:35 p.m.
Minutes:
- Unanimous approval was granted for minutes of May 1, 3, 8,
10, 15, 17, 22, and 30 with a motion from Mr. Brachwitz and second from Mrs.
Perkins.
Reports:
- Treasurer’s Report
– Barbara Dunn reported the following May account balances: General Fund, $118,160.98; State Fund,
$100,252.72; Kimberton Sewer Fund, $16,998.94; Road Repair Loan Fund,
$13,995.29; Township Building Loan, $690,286.56; St. Stephens Greene Water
Fund, $19,087.67; and St. Stephens Greene Sewer Fund, $33,399.00.
- Police Report –
Police Chief Karl Jones reported that the Police Department responded to 86
calls in May. The Department
investigated several accidents; two arrests were made for driving under the
influence of alcohol and controlled substance and for causing a disturbance
inside the Sunoco Station; and the Department assisted several area police
departments on calls involving domestics, accidents, and assaults.
- Solicitor’s Report –
Solicitor Greenwood reported working on the Strawbridge Conditional Use, Fasel
Subdivision, St. Stephens Greene and Vincentshire road dedication and escrow,
and Gannett Fleming, Inc. contract for services with the Township.
Correspondence:
- Correspondence was received from
the Chester County Health Department regarding West Nile Virus;
copies of the letter and pamphlet entitled "West Nile Encephalitis: What you need to know to protect yourself
and loved-ones" are available on the display table or www.chesco.org/health/westnile.htm
for further, more detailed information.
- In a letter dated May 22nd,
Saul Schapiro asked the Township to write a letter to Comcast Cable
requesting the availability of internet access service to Township residents;
Manager Heist will send a letter to Comcast Cable.
- Correspondence was received from
Green Valleys Association requesting a letter of support for the Schuylkill
River Conservation Plan; Manager Heist will send a letter endorsing
this plan prepared by The Conservation Fund, Natural Lands Trust, and The
Patrick Center for Environmental Research at the Academy of Natural Sciences
through funding provided by the DCNR and the William Penn Foundation.
Subdivision/Land Development/Zoning:
- The Board unanimously
acknowledged receipt of a subdivision extension agreement for the Owen
J. Roberts (Griffith Tract) plan extending review time to August 1,
2000 upon a motion from Mr. Brachwitz and second from Mrs. Perkins.
- An agreement for subdivision
review extension to July 10, 2000 for the Kling Subdivision
was acknowledged with a motion from Mr. Brachwitz and second from Mrs. Perkins;
the motion carried unanimously.
- A motion was made by Mrs. Perkins
to reimburse collected impact fees to West Vincent Capital, Inc.
(The Woods at Callow Hill) in the amount of $6,260.00 for the paving of
Malehorn Road as previously agreed upon; the motion was seconded by Mr.
Brachwitz and carried unanimously.
- Ronald Agulnick, Esquire and Lisa
D’Andrea were present to review the revised subdivision plan for James
and Karyn Fasel, 1245 School House Road and request final plan
approval.
- A unanimous motion was made by
Mr. Brachwitz, seconded by Mrs. Perkins, to grant a waiver from Section 403.2
of the Township Subdivision and Land Development Ordinance, which requires a
Hydrogeologic Impact Study. In lieu of
this study, an analysis has been prepared which shows that the proposed
development on this site will have a recharge coefficient greater than 1.
- A motion was made by Mr.
Brachwitz to grant a waiver from Section 403.4 of the Township Subdivision and
Land Development Ordinance, which requires a Stormwater Management Plan. Stormwater Management calculations and
design for the lots shall be submitted at the time of building permit
application and reviewed and approved by the Township Engineer and/or Building
Inspector. The motion was seconded by
Mrs. Perkins and carried unanimously.
- Mr. Brachwitz moved to accept the
submitted plan as a final subdivision plan; the motion was seconded by Mrs.
Perkins and carried unanimously.
- A motion was made by Mr. Miller,
seconded by Mrs. Perkins, to grant final approval for the James
and Karyn Fasel Subdivision Plan condition upon:
- Township
Solicitor’s review and approval of the TDR Restrictive Covenant agreement
- Township
Engineer’s verification of the TDR calculation
- Verification
of hydrogeologic data at building permit application stage
- Compliance
with all notes made part of the subdivision plan
- Motion carried with Miller and
Perkins voting in favor and Brachwitz opposed granting approval prior to
satisfaction of the conditions.
- Unanimous approval was granted
for Wetherill Estates Escrow Release No. 9 in the amount
of $9,955.42 upon a motion from Mr. Brachwitz and a second from Mrs. Perkins.
- A motion was made by Mrs.
Perkins, seconded by Mr. Brachwitz, to adopt Resolution 7-2000,
accepting the offer of dedication of Red Fox Lane in the Vincentshire
Subdivison; the motion carried unanimously.
Old Business:
- The Police Department submitted
draft copies of three ordinances, Curfew Ordinance, Disturbing
the Peace Ordinance, and License and Regulations for Soliciting
or Peddling Ordinance; the ordinances have been adopted
in neighboring Townships and will assist the Police by providing penalties in
handling situations involving curfew for minors, disturbing the peace and
solicitation. Solicitor Greenwood will
review the draft ordinances and submit comments.
- A motion was made by Mr.
Brachwitz to accept the quotation from Davidheiser’s Inc. for an Enradd
Infrared speed timing system, training, and laser level at a total cost
of $3,300.000; the motion was seconded by Mrs. Perkins and carried unanimously.
Bills List:
- Mr. Brachwitz made a motion to pay the bills on the Bills
List dated June 12, 2000; it was seconded by Mrs. Perkins and carried
unanimously.
There being no further business,
Mrs. Perkins moved the meeting be adjourned; the motion was seconded by Mr.
Brachwitz and the meeting adjourned at 9:30 p.m. An executive session was held regarding the SLC Senior Living,
LLC conditional use application.
