BOARD OF SUPERVISORS
MINUTES - MAY 8, 2000

The regular meeting of the West Vincent Township Board of Supervisors
was held on the above date at the Township Building. Chairman Kenneth
Miller called the meeting to order at 7:36 p.m.; others in attendance
were Supervisors Karl Brachwitz and Zoë Perkins, Township Manager
Allen Heist, and Township Solicitor Allan Greenwood.
Minutes:
- Unanimous approval was granted for minutes of April 3, 4, 10, 17,
24, and 25 with a motion from Mr. Brachwitz and second from Mrs.
Perkins.
Reports:
- Treasurer's Report - Barbara Dunn reported the
following April account balances: General Fund, $40,701.83; State Fund,
$9,628.24; Kimberton Sewer Fund, $16,586.41; Road Repair Loan Fund,
$13,925.43; Township Building Loan, $686,840.68; St. Stephens Greene
Water Fund, $18,199.56; and St. Stephens Greene Sewer Fund, $32,920.62.
- Police Report - Police Chief Karl Jones reported
that the Police Department responded to 68 calls and completed 80 hours
of school in April. The Department is investigating several thefts from
vehicles along Jaine Lane; three accidents were investigated with one
resulting in an arrest for driving under the influence of alcohol and
controlled substances; an arrest was made for public drunkenness and
disorderly conduct; and approximately thirty citations were issued for
various violations during the annual fishing season opening.
- Solicitor's Report - Solicitor Greenwood reported
working with Manager Heist on the Fasel Subdivision, securing an
attorney regarding PSW's proposal for the St. Stephens Greene and
Wetherill Estates Water Plants, and Horseshoe Farms road dedication and
stormwater easements.
- Mrs. Perkins noted that a legal opinion was recently received from
the Commonwealth Court denying the Michael and Janet Polay
appeal. The Polays' challenged the validity of the West Vincent
Township Zoning Ordinance concluding that the Ordinance excludes as a
land use the collection and removal of spring water for commercial
purposes within the Township.
Correspondence:
- A motion was made by Mr. Brachwitz, seconded by Mrs. Perkins, to
renew the Traffic Signal Maintenance Contract with Signal
Service Inc. The contract cost remained the same as last year. The
motion carried unanimously.
- Correspondence was received from East Pikeland Township indicating
that the Township is not inclined to enforce the Kimberbrae Trail
Easement at this time. A copy of this correspondence will be
sent to Kimberbrae residents. Mrs. Perkins added that the West Vincent
Land Trust feels that the Kimberbrae Trail issue is a Board of
Supervisors concern, but is ready to accept the Kimberbrae Trail
Easement if and when enforced.
Subdivisions/Land Development/Zoning:
- Castle Valley Consultants has reviewed the proposed design and
details submitted by Benchmark Consulting Engineers and Surveyors
pertaining to an additional stormwater pipe design to eliminate the
ponding rainwater in the cul-de-sac on South Iroquois Lane,
Wetherill Estates. A motion was made by Mr. Brachwitz to
forward an approval letter to Zachrey Colburn, Southdown Homes, for
installation of this expanded stormwater management system; this project
is not included as an escrow account punchlist item. The motion was
seconded by Mrs. Perkins and carried unanimously.
- An agreement for subdivision review extension to June 15,
2000 for the Owen J. Roberts School District (Griffith property)
was acknowledged with a motion by Mr. Brachwitz and second from
Mrs. Perkins; the motion carried unanimously.
- Ronald Agulnick, Esquire and Lisa D'Andrea were present to review
the revised subdivision plan (Tier III) for James and Karyn
Fasel, 1245 School House Road. The plan shows the 35 acre tract
divided into Parcel A, which consists of three residential lots - 2.8
acres, 7.77 acres, and 2.9 acres - deed restricted against further
subdivision and a 50% Greenway Area set aside; and Parcel B, a 21.4 acre
lot, reserved for use as a single-family residence. An existing 50-foot
access right of way will be conveyed to Robert and Linda Wells. TDR
calculations of eight units were generated for Parcel A - three units
reserved for development and five units remaining.
Mr. Agulnick submitted draft copies of a Restrictive
Covenants agreement and Installation and Maintenance Agreement
for an On-Lot Sewage Disposal System for review. Other issues to be
reviewed prior to granting final plan approval include: Township
Engineer's verification of TDR calculations; Applicant's Engineer will
add a Plan note regarding stormwater management to be addressed at
Building Permit application stage and the items (excluding stormwater
issues) included in the Township Engineer's letter dated May 8, 2000
will be incorporated on the Plan; submission of a formal written waiver
request from Section 4031.2 of the Subdivision and Land Development
Ordinance requiring a Hydrogeologic Impact Study; and review of the
specific placement of buildings/building envelopes of Parcel A as they
relate to meeting the intent of the TDR Section of the Zoning Ordinance.
The discussion was tabled until the Monday, May 15th
administrative meeting.
The Board unanimously acknowledged receipt of a subdivision
extension agreement for the Fasel Subdivision
extending review time to May 16, 2000 upon a motion from Mr. Brachwitz
and second from Mrs. Perkins.
- An agreement for subdivision review extension to August 1,
2000 for the Columbia Gas Transmission land development
plan was acknowledged with a motion from Mr. Brachwitz and second from
Mr. Miller. The motion carried with Brachwitz and Miller voting in
favor; Perkins abstained.
- Two bids were received for purchase, installation and start up of
fifteen time meters at the St. Stephens Greene Sewage Treatment
Plant; Manager Heist will verify that the Hoishik Electric Inc.
bid includes purchase of the meters. The issue was tabled until the May
22nd meeting.
- John Bachich and Dave Beideman were present to discuss stormwater
management (swales versus curbs) for the single access street for
Laymen's Home Missionary Movement proposed 33-lot
subdivision on St. Matthews Road. The Board indicated a non-binding
inclination to favorable support a 20' cartway with 2' rolled curbs (24'
total width) and the proposed internal street widen at all
intersections.
- Solicitor Greenwood indicated he is finishing the paperwork for
Brighton Way (Birchrun Hills Subdivision) road dedication.
Mr. Greenwood will forward the deed to the Title Company upon receipt of
the marked-up title report.
Old Business:
- Three quotes were received for plant materials to complete
Phase 1 of the Township Park Landscape Plan. A motion was
made by Mr. Brachwitz, seconded by Mrs. Perkins, to accept the bid from
Shemin Nurseries Inc., Oaks, in the amount of $5,611.60; the motion
carried unanimously.
Business from the Floor:
- Township resident Thoma Johnson requested mowing and weed removal
on either side of the guiderail installed on Flowing Springs Road
(approximately 1/4 mile north of Hollow Road) along the curve in the
road. Mr. Miller advised that the road crew began mowing Township roads
in May. Mr. Johnson also mentioned his concern regarding traffic
speeding on Flowing Springs Road in the vicinity of the
"curve" and Sheeder Mill Road. Police Chief Jones will
provide information, specs, and price estimates for an ESP timing device
to the Board.
Bills List:
- Mr. Brachwitz made a motion to pay the bills on the Bills List
dated May 8, 2000; it was seconded by Mr. Miller and carried
unanimously.
There being no further business, Mr. Brachwitz moved the meeting be
adjourned; the motion was seconded by Mrs. Perkins and meeting adjourned
at 9:22 p.m. An executive session was held regarding potential
litigation and personnel matters.
