ENVIRONMENTAL ADVISORY COUNCIL
MINUTES - April 3, 2000

ATTENDING Chairperson Craig Hannafin, Vice Chairperson
Pam Shillingford-Brown, Members Laura Hardt, Jan Beale and Pete Moscufo,
Township Manager Allen Heist.
The Chairperson called the meeting to order at 9:35 a.m. Minutes from
the February 7, 2000 meeting were approved.
ADMINISTRATIVE:
- Board of Supervisors - A resident on Red Fox Lane has asked
Ludwigs Corner Fire Co. to disconnect the alarm or to at least
limit the use of the alarm. This matter is being looked into. Mr. Burch
bought the Dawes Property and implemented the use of transferable
development rights on the 77 acres. Mr. Burch will offer the TDR's to
the Land Trust first if he decides to sell them. No settlement has been
signed regarding the Hankin property. A Conditional Use Hearing
for Columbia Gas Transmission has been set for April 3,2000 at
7:30 p.m. at the Township building.
MAIL:
- CC Bikeway Map was received; Laura Hardt will review this
and report back to the EAC.
- Michael Palasz is the current owner of Lot 5 in the
Horseshoe Farms Subdivision, which contains a storm water management
basin utilized by the subdivision. Mr. Palasz is proposing to convert
the present facility into a combination facility that provides the
permanent water retention of a pond.
REPORTS:
- Notice of Violation was given to St. Stephen's Green from
CC Health Department in accordance with the Pennsylvania Safe Drinking
Water Act. The Health Department has not received the results of the VOC
monitoring for 1999.
- Columbia Transmission Corp has received notice from Green
Valleys attorney of intent to file a lawsuit pursuant to the Clean
Streams Law. Wetlands encroachment permit violates the regulations
concerning the stream crossing and the encroachment in wetlands.
- Coventry Little League has sent a letter concerning the
Township Park and their interest in utilizing the field. All
requests will be reviewed. Landscaping will be done this spring, we are
waiting for quotes.
- A review letter from Chester County Conservation District dated
February 22, 2000 regarding the Erosion & Sedimentation application
for Evans Farm (Municipal Building) has been reviewed by Castle
Valley Consultants, Inc.,
- Tim Sloan (Matthews Meadows) has received a notice of
violation for the treatment plant, there is a concerns that the plant
has not been in compliance the PADEP.
- Wheeler Amen was present to talk to the EAC and Board of
Supervisors liaison regarding the Kimberbrae Trail which has been
an on coming issue. Zoe Perkins informed Wheeler that the only choose he
has at this time was to enforce the No Trespassing law by calling the
local police and meeting with the West Vincent Land Trust on Tuesday to
see if any thing can be done to purchase the trail easement. Grant money
may be used to buy the easements from the homeowners. Another
alternative was to sue the Township and let the issue be resolved by the
courts. Mrs. Perkins will go out to the site and review this issue
again.
ZONING:
- Columbia Gas Transmission submitted a land development plan
for a 30-acre property at 315 Fellowship Road. Review letters have been
received from CC Health Department, Upper Uwchlan Township, CC
Conservation District, CC Planning Commission and The Army Corps of
Engineers. There is a Conditional Use hearing for Columbia Gas
Transmission on Monday, April 3, 2000 p.m. at 7:30 at the Township
building.
- James and Karen Fasel submitted a four-lot preliminary
subdivision plan for 36 acres on School House Lane, review letters are
back from CC Health Department, CC Planning Commission and Army Corps of
Engineers.
- Vince Kling submitted a lot-line change; the property is on
the S.E. side of Birchrun Road and Shady Lane. The plan has been sent
out for review.
New Business:
- Mrs. Travalgini was present to discuss the guardrail and roadwork
done on Green Lane.
The Travalgini's are very disappointed with the turnpike like
guardrail that has been put up, the guardrail is PennDOT approved. The
township will have the engineers look into this matter. Plus they would
like the mess left from the roadwork cleaned up.
- The issue of Spring Peepers on Hollow Road was presented to the
EAC, no solution to this matter at this time.
The meeting was adjourned at 11:50, the next meeting will be held
Monday, May 1, 2000
