CONDITIONAL USE HEARING

(UNAPPROVED)

The fourth conditional use hearing to consider the application of SLC Senior Living, LLC was held on the above date at the Township Building. Chairman Kenneth Miller called the public hearing to order at 7:38 p.m.; others in attendance were Supervisors Karl Brachwitz and Zoë Perkins, Township Solicitor Allan Greenwood, Township Manager Allen Heist, Township Code Enforcement Officer Robert Wideman, Mark Hagerty, court reporter, and John E. Good, Esquire, representing the applicant.

The purpose of the hearing was to take formal action on the application of a conditional use permitted under Section 603B.7 pursuant to Sections 2212 and 2711 of the West Vincent Township Zoning Ordinance to construct a life care community on tax parcels 25-7-8 (24.8 acres fronting on Route 401 zoned R-2 with a Mobile Home Park Overlay) and 25-7-8.2 (13.4 acres fronting on Black Horse Road zoned R-2). The applicant proposes 31 duplex cottages (62 units), 84 assisted living facility luxury suites, and 70 assisted living facility standard suites.

Chairman Miller stated that the hearing procedures for hearing dates after January 24, 2000 read during the previous hearings applied also to this hearing. Solicitor Greenwood invited submission of additional Entry of Appearance forms and one entry of appearance was filed as follows:

Solicitor Greenwood stated that Jamie McVickar, representing his parents Paul and Clarita McVickar, had been granted party status on January 24, 2000; however, since Jamie McVickar was not present, Mr. McVickar would like to enter an appearance as party to the proceedings; the Board confirmed party status in the conditional use hearing for Mr. McVickar.

As a follow-up to his request at the previous hearing, Richard Mulcahey, Esquire inquired as to the availability of a copy of the Personal Care Home license issued for Woodbridge in Kimberton. Mr. Stevens will mail a copy of the license to Mr. Mulcahey.

John E. Good, Esquire presented Applicant's third witness, Martin Kimmel, architect and President of Kimmel Bogrette Architecture + Site, Inc., Conshohocken, PA. The following board exhibits were submitted for the record and reviewed by Mr. Kimmel: (Mr. Good offered to submit "fold-up" versions of the board exhibits to the Township Solicitor and to the Township Office.)

Upon completion of testimony, the Board of Supervisors, Manager Heist, and Township Code Enforcement Officer Robert Wideman asked questions seeking clarification of the evidence presented.

Following a fifteen-minute recess, Chairman Miller reconvened the hearing at 9:15 p.m. Parties, Christa Jones and Richard Mulcahey, Esquire, cross-examined the witness. The conditional use hearing in connection with the application of SLC Senior Living, LLC will resume with Mr. Mulcahey's finishing cross-examination of Mr. Kimmel and will continue with party cross-examination by parties other than Mrs. Jones and Mr. Mulcahey on Tuesday, April 25, 2000 at 7:30 p.m. at the West Vincent Township Building. In the event that a sixth hearing is required, a hearing date of Wednesday, May 10, 2000 at 7:30 p.m. was selected.

Mr. Kimmel was not sure if he would be available for the hearing of April 25th but will advise Mr. Good of his schedule; Mr. Good indicated that he had two remaining witness whose testimony will not take long. If Mr. Kimmel is not available for the April 25th hearing, Mr. Mulcahey (attorney for Kurt Deisher) will be prepared to present his witnesses; cross-examination of Mr. Kimmel will continue May 10th.

The hearing was adjourned at 10:10 p.m.
