BOARD OF SUPERVISORS
MINUTES - FEBRUARY 14, 2000
(UNAPPROVED)
The regular meeting of the West Vincent Township Board of Supervisors
was held on the above date at the Township Building. Chairman Kenneth
Miller called the meeting to order at 7:35 p.m.; others in attendance
were Supervisors Karl Brachwitz and Zoë Perkins and Township
Manager Allen Heist.
Reports:
- Treasurer's Report - Barbara Dunn reported the
following January account balances: General Fund, $22,100.38; Payroll
Account, $3,621.87; State Fund, $1,299.30; Kimberton Sewer Fund,
$14,178.52; Road Repair Loan Fund, $11,266.69; Township Building Loan,
$677,428.00; St. Stephens Greene Water Fund, $18,544.92; and St.
Stephens Greene Sewer Fund, $32,957.39.
- Police Report - Police Chief Karl Jones reported
that the Police Department responded to 59 calls in January. The
Department assisted neighboring Police Departments on various incidents;
handled four minor accidents; investigated three false alarms; and made
one arrest for Drug Act 64 along French Creek Road. The West Vincent
Police will continue to conduct speed details throughout the Township
and have made arrangements with the Chester County Highway Safety
Project to use their speed display sign for two weeks to let the public
see how fast they are driving.
Minutes:
- Unanimous approval was granted for minutes of January 4, 10, 17,
24, and 31 with a motion from Mr. Brachwitz and second from Mrs.
Perkins.
Correspondence:
- Correspondence was received from Calhoun, Baker Inc. concerning a
change in the Delaware Valley Regional Finance Authority loan
program; in 1994, DVRFA issued a 20-year variable rate loan for
the Township's Kimberton Sewer Extension Project. The new program
offers fixed rate options that were not previously available. Manager
Heist will conduct a survey of the remaining residents in the Kimberton
Sewer Extension Project regarding converting the existing loan from
variable rate terms to a fixed rate and report his findings to the
Board.
- As a result of engineering and traffic studies on South
Chester Springs Road from Conestoga Road to the Township line,
PennDOT has determined the following:
- Reduction to 40 MPH on S. Chester Springs Road between Conestoga
Road and Horseshoe Trail
- Reduction to 35 MPH on S. Chester Springs Road between Horseshoe
Trail and the Township line (The Township is
responsible for installation of this sign.)
- Installation of new regulatory and warning signs
- A letter was received from the U.S. Department of Commerce
Bureau of Census requesting the use of the Township Building to
conduct testing sessions for part-time census employees. The Board
approved the request provided that there are no conflicts in
scheduling.
- The Chester County Health Department announced the Household
Hazardous Waste Collection dates for the year 2000 as follows:

- The annual Spring Convention of the Chester County
Association of Township Officials will be held Thursday, March
2nd at the Lionville Best Western; Mrs. Perkins and Manager
Heist will attend.
Subdivision/Land Development/Zoning:
- A unanimous motion was made by Mr. Brachwitz, seconded by Mrs.
Perkins, to acknowledge receipt of a conditional use application
from Columbia Transmission Communications Corporation.
The applicant desires to use the property located at 310 Fellowship Road
for construction of a telecommunications building as an extension of a
new fiber optic cable system located along existing natural gas
rights-of-way to provide service to communications companies. A hearing
date was set for Tuesday, March 21, 2000 at 7:30 p.m. at the Township
Building.
- Mrs. Perkins moved that the Agreement for Temporary
Wastewater Holding System between Robert and Kathleen Kaiser
(Lot 3 Houndstooth Lane) and West Vincent Township as prepared by
Fronefield Crawford be approved. A memorandum was received from Mr.
Kaiser advising that he is in agreement with the recommended revisions
to the temporary wastewater holding system per Code Enforcement Officer
Robert Wideman's letter dated January 24, 2000 and that he will place
$1,000 in escrow to assure compliance. The motion was seconded by Mr.
Brachwitz and carried unanimously.
Old Business:
- John Hoekstra and Laura Hardt, Green Valleys Association, were
present to review the French Creek Scenic Restoration
Project. Demolition of the Arena Slaughterhouse at the corner
of Hollow and Pughtown Roads in East Vincent Township, projected for
completion Summer 2000, will consist of removal of the building and its
components in an environmentally responsible manner, re-establishment of
proper groundwater recharge, and restoration of the property to its
natural riparian state. An environmental assessment completed in July
1999 indicated no evidence that toxic chemicals had been used on the
site or of any residual chemical contamination. Property restoration
of the site includes restoring vegetation by utilizing native plant
materials and wildflower seed mix to create a 75' deep buffer from
French Creek, stabilizing the stream bank, and creating a small gravel
parking area and footpath to access a fishing area and scenic overlook.
The Board commended Green Valley's efforts.
- Police Chief Jones indicated that a Litter Ordinance
would assist the Police, especially during fishing season; he will
review a sample ordinance and present a revised version to the Board for
consideration.
- Don Tantala and Tracy Bair, representatives from the Glenmoore
Eagle Youth Association, were present to discuss with the Board the use
of the Township Park athletic fields for G.E.Y.A. Little
League and Soccer teams approximately two evenings per week and
Saturdays; the organization has a broad base of volunteers to assist
with field development and maintenance. Since the grass fields may not
be available for use this year due to last summer's drought conditions,
the information presented will be kept on file for further discussion in
2001.
New Business:
- Albert Ulozas and Stephen Steging, St. Stephens
Greene property owners, were in attendance to discuss road
maintenance service for the development and the process of offering
Barrington Lane to the Township for dedication. As a follow-up to the
lengthy discussion that ensued, a memorandum and copy of the punch list
generated by the Township Engineer will be sent to all St. Stephens
Greene homeowners and the Board will request of the Township Solicitor
his recommendations and comments regarding contacting the responsible
party about completion of the punch list items and a tentative time
table, requesting an increase in the current escrow account which
according to the Engineer's estimates is deficient, and filing a lien
for past due engineering fees or sending a letter to become a creditor.
The St. Stephens Greene H.O.A. Board will be advised of any action taken
by the Township.
- A motion was made by Mr. Brachwitz to appoint Peter
Moscufo to the Environmental Advisory Council; the motion was
seconded by Mrs. Perkins and carried unanimously.
Business from the Floor:
- William Collier, Jaine Lane, has requested the Board to consider
painting center or edge markings on Township roads for
safety purposes. Manager Heist will compile a list of all Township
roads twenty feet wide or more for the Board's review; Mr. Heist
indicated that a joint bid for road striping is available through the
Chester County Consortium.
- Peter Rodgers questioned whether SLC Senior Living,
LLC, which did not seem to comply with the "continuum of
care" requirement and life care community definition of the
Township Zoning Ordinance, qualifies for a conditional use hearing.
Testimony regarding these issues will be presented to the Board during
the course of the hearing.
Bills List:
- Mrs. Perkins made a motion to pay the bills on the Bills List
dated February 14, 2000; it was seconded by Mr. Brachwitz and carried
unanimously.
There being no further business, Mr. Brachwitz moved the meeting be
adjourned; the motion was seconded by Mrs. Perkins and the meeting
adjourned at 9:35 p.m.
