BOARD OF SUPERVISORS
MINUTES - DECEMBER 20, 1999

The administrative meeting of the Board of Supervisors, held in the Township Building, was called to order at 8:05 a.m. by Vice Chairman Zoë Perkins; also in attendance were Supervisor Karl Brachwitz, Township Manager Allen Heist and Planning Solicitor Fronefield Crawford.

Southdown Homes has requested a waiver from the 10' side and rear yard setback requirement for driveways (Section 2103 G.) allowing the driveway on Wetherill Estates Lots 35 and 37 to be not closer than five feet of the property line. Prior to taking action, the Board requested verification that adjacent lot owners (Lots 34 and 36) be notified of the waiver request. Michael Marks, Wetherill Estates Construction Superintendent, was present to submit a letter from Harry Syer, adjacent property owner (Lot 34), approving the Lot 35 waiver request provided that the contractor relocate the mailbox on Lot 35 to the other side of the driveway to accommodate landscaping around the mailbox without encroaching on his property. Timothy Golden, adjacent property owner (Lot 36), was present to voice his concerns regarding drainage problems and increased runoff onto his property from Lot 37. Mr. Marks will inspect the site and contact Manager Heist with his findings and recommendations. Mr. Brachwitz stated he was inclined not to grant the waiver requests and recommended the contractor cut the driveways and shorten the aprons to maintain the 10' setback; Mrs. Perkins was inclined to grant the waiver requests conditioned upon Southdown Homes satisfactorily addressing Mr. Golden's concerns. The Board will take action on the waiver requests Monday, December 27th.

Malcolm Jacobson, Esquire and Alan Escott, Esquire, representing Robert Burch, were present to discuss Mr. Burch's purchase of the 77.7 acre Dawes property and subsequent conveyance of the property to a prospective purchaser. Mr. Burch proposes to purchase the Dawes property from the current owners, utilizing the TDR provisions of the Zoning Ordinance; the Dawes property would be a sending property. Fronefield Crawford will review a TDR easement, drafted by Mr. Jacobsen, restricting the 77.7 acres to a total of four dwelling units. The policy of the Zoning Ordinance is to preserve prime agricultural lands, soils and visual resources; it was suggested that the draft easement include a "no-build" area delineated 100' in front of the existing treeline or in accordance with the Tier I setback requirements, whichever is greater. A map delineating building setback lines will be prepared by Conservation Advisors and reviewed with the prospective purchaser.
