PLANNING COMMISSION
NOVEMBER 18, 1999
ATTENDING Chairman Jim Wendelgass, Vice Chairperson

Chairman Wendelgass called the meeting to order at 7:35 p.m.
The following correspondence was reviewed:
- A letter was received from James Gerlach's office regarding the
Senate Bill 300. This was a significant event in the progress of
land use and growth management legislation because it will permit a full
debate and vote on this important legislation in the Senate for the
first time since revisions were made to the Municipalities Planning Code
back in 1988.
- It is the policy of both the Chester County Planning
Commission and Health Department to request all
municipalities to adopt an ordinance requiring regular management,
inspection and pump-out of all individual sewage systems, established in
a legally enforceable manner.
- Frone Crawford researched the issue whether an Open Space
Referendum can be placed again on the ballot of either the primary
or general election in 2000. The answer is yes- there are no statutory
restrictions on placing an open space referendum back on the ballot
after an open space referendum has been defeated.
- Environmental Protection Agency sent a fact sheet based on
the Storm Water Phased II Proposed Rule. The information is subject to
change upon publication of the finial Phase II Rule in November 1999.A
revised series of fact sheets will be provided at that
time.
- Mr. Foley of Brutcher, Brutscher & Foley filed a short brief
with the Commonwealth Court on behalf of the Township Zoning and Code
Enforcement Administration regarding the appeal of Michael S. and
Janet S. Polay.
REPORTS AND ZONING:
- A continuation hearing for Paul W. Pitcher and Shirley
Pitcher seeking zoning relief in order to permit the construction of
a single home on French Creek Road has been set for Monday, November 26,
1999, Monday, December 6, 1999 and Tuesday, December 14, 1999 at 7:00
p.m. at the Township building.
- A Zoning Hearing Board hearing for Columbia Gas
Transmission has been set for Tuesday, December 14, 1999 and
Wednesday, January 19, 2000 at 7:00 p.m. at the Township Building. Susan
Levit with Columbia Gas Transmission, David Beideman and Ray Rase with
Beideman Assoc. and Mr. Brooman of Drinker, Biddle & Reath were
present to talk to the Planning Commission on the proposed construction
of a 8,000 square foot unmanned structure to provide an essential
support service to the fiber optic network. This building will be
secured and will not generate any noise, odor, sanitary sewage or solid
waste. Mr. Senn, a resident of Upper Uwchland Township, was present to
express his concerns of this structure, directly across from his home.
The Planning Commission asked CTC to look at other areas on the property
to see if the structure could be relocated. Vince Kling will walk the
property to see if they have other options.
SUBDIVISIONS:
- Castle Valley reviewed the proposed Act 537 plan revision for the
Hankin Tract. The Planning Modules remain incomplete. Before the
module is approved, they recommend that the applicant revise the
submission to address a number of requirements of the Conditional Use
Order. Judge Shenkin held an Administrative Conference on the Huston
appeals from the Zoning Ordinance amendment and conditional use approval
pertaining to the Hankin tract on Thursday, October 28, 1999. Frone
Crawford's letter explains that Judge Shenkin is going to appoint a
special master to take testimony. The master will make a report and a
recommendation to Judge Shenkin, after which he will enter his own order
with respect to the appeal.
- Review letters have been received from the Chester County Health
Department and Castle Valley Consultants on the Dawes Farm and
Long Lane revised October 12, 1999 preliminary subdivision.
Approval letter from the Chester County Conservation District should be
provided and all other issues must be addressed before granting
preliminary plan approval.
- It is the position of The West Vincent Township Planning
Commission after reviewing Castle Valleys letter that the 2 lot
subdivision on Wyndemere Lake Drive (Cotswold Estate) be given
final approval. A motion was made by Vince Kling and second by Jean
Warrick.
- David Beideman of Beideman Associates and John Bachich was present
to review step 4 and 5 on the Layman's Home property project and
the difference between Tier 3 and Tier 4. The next step will be for John
Bachich to submit a sketch plan.
BUSINESS FROM THE FLOOR:
- Jean Warrick reminded the Planning Commission they will need to
make a decision at their December meeting regarding the number of
members that should be on the commission.
Minutes from the October 21,1999 meeting were
approved.
