BOARD OF SUPERVISORS
MINUTES - OCTOBER 11, 1999
The regular meeting of the West Vincent Township Board of Supervisors
was held on the above date at the Township Building. Chairman Kenneth
Miller called the meeting to order at 7:35 p.m.; others in attendance
were Supervisors Zoë Perkins and Karl Brachwitz, Township Manager
Allen Heist and Township Solicitor Allan Greenwood.
Bid Opening:
- As advertised for this date, bid proposals were received and
opened for 1999-2000 Snow and Ice Removal as follows:

A fourth bid was received from Machinery Services, Inc. with the
notation "no bid". Bids will be reviewed by Board members and
the Road Foreman and the snow and ice removal bid will be awarded on
Monday, October 18, 1999 at 8:00 a.m. during the administrative
meeting.
Public Hearing:
- A public hearing to consider enactment of Ordinance No.
101-1999, an ordinance amending various sections of the Zoning
Ordinance and Ordinance No. 102-1999, an ordinance
amending various sections of the Subdivision and Land Development
Ordinance, was called to order at 7:40 p.m. by Chairman Miller. This
meeting was a continuation of the public hearing held September 13,
1999. The ordinance amendments consist of "general housekeeping
items" recommended by the Planning Commission, EAC, Code
Enforcement Officer and Township Manager since the ordinances were
originally adopted in December 1998. The Zoning Map amendment revising
the district boundaries of the Birchrunville Village District was
deleted from the agenda and will be advertised for a future public
meeting.
A motion was made by Mr. Brachwitz, seconded by Mrs. Perkins, to
adopt Ordinance No. 101-1999, amending various sections of the
Zoning Ordinance of 1998. The motion was seconded by Mrs. Perkins and
carried unanimously.
Mrs. Perkins moved to adopt Ordinance No. 102-1999, amending
various sections of the Subdivision and Land Development Ordinance of
1998. The motion was seconded by Mr. Brachwitz and carried
unanimously.
Continuation of Regular Meeting:
The regular meeting was called to order at 7:47 p.m.
Minutes:
- Unanimous approval was granted for minutes of September 7, 13, 20,
and 27 with a motion from Mrs. Perkins and second from Mr. Brachwitz.
Reports:
- Treasurer's Report - Mike Burnley reported the
following September account balances: General Fund, $98,464.38; State
Fund, $60,585.55; Kimberton Sewer Fund, $11,860.20; Road Repair Loan
Account, $15,196.11; St. Stephens Greene Water Fund, $14,690.74; St.
Stephens Greene Sewer Fund, $31,230.23; and Township Building
Construction Fund, $709,909.55.
- Tax Collector's Report - Received from Berkheimer
Associates: Delinquent Real Estate Tax, $1,838.24; Debt Service - Road
Repair Loan, $1,915.23; and Earned Income Tax, $27,837.60. Received
from Chester County: Real Estate Transfer Tax, $41,122.01.
- Police Report - The Police Department responded to
112 calls in September. One criminal arrest was made for forgery;
several accidents were investigated; traffic details on various Township
roads will increase in response to resident's complaints regarding
speeding; and Township residents and business owners are reminded to
have their alarm systems serviced after experiencing a false alarm.
- Solicitor's Report - Solicitor Greenwood reported
filing two municipal liens against delinquent properties in the
Kimberton Sewer Extension Project for the full balance owed for
construction costs and sewer assessment; the 1999 BOCA and 1997
International Plumbing Code have been advertised to consider for
adoption on Monday, October 25, 1999; and the Daniel Grubb conditional
use decision was drafted.
Correspondence:
- Governor Ridge has lifted the drought emergency that
has been in place since July 20th. Chester County has been
moved to a "drought watch" phase, which is the first and least
severe of the three types of drought declarations.
Subdivision/Land Development/Zoning:
- An agreement for subdivision review extension to December
31, 1999 for Michael Matlock (Dawes Farm) was acknowledged
with a motion from Mr. Brachwitz and second from Mrs. Perkins; the
motion carried unanimously.
- Columbia Gas Transmission Corp., 310 Fellowship
Road, has applied for a hearing before the Zoning Hearing Board to
request a special exception to Zoning Ordinance Section 2601.C
pertaining to expansion of non-conforming uses, in order to place a
telecommunications building on property currently owned by the
applicant. The telecommunications building will be a support facility
for a new fiber optic cable system, currently under construction. The
hearing will take place Wednesday, November 17, 1999 at 7:00 p.m. at the
Township Building.
New Business:
- A Township resident has asked the Board to consider sending a
letter to PennDOT requesting a four-way stop at the intersection of
Horseshoe Trail and St. Matthews Road. The Board was opposed to
pursuing a four-way stop at this time, however, due to limited sight
distance resulting from the overgrown vegetation and barn foundation on
the southwest corner of the intersection, the Township Manager will
investigate the property's subdivision records, which may require the
barn ruins to be removed and forward a letter to PennDOT.
- Mrs. Perkins reported that the Township newsletter would be
mailed Friday, October 15th. West Vincent Land Trust members
will be calling registered voters to remind them of the referendum
question on the November ballot to approve additional taxation at
the rate of .56 mills to purchase and preserve open space lands.
Bills List:
- Mr. Brachwitz made a motion to pay the bills on the Bills List
dated October 11, 1999; it was seconded by Mrs. Perkins and carried
unanimously.
There being no further business, Mrs. Perkins moved the meeting be
adjourned; the motion was seconded by Mr. Brachwitz and the meeting
adjourned at 8:00 p.m. An executive session was held regarding real
estate issues.
