WEST VINCENT TOWNSHIP
ZONING AMENDMENT AND HANKIN CONDITIONAL USE HEARING
MINUTES - MAY 27, 1999

The West Vincent Township Board of Supervisors held a public meeting at 7:00 p.m. on Thursday, May 27, 1999, at the Ludwigs Corner Fire Company; this meeting was a continuation of the public hearing held Wednesday, May 19, 1999. Chairman Miller called the meeting to order at 7:10 p.m.; also in attendance were Supervisors Zoë Perkins and Karl Brachwitz, Township Manager Allen Heist, Planning Solicitor Fronefield Crawford, and Norma Gerrity, court reporter. The purpose of the meeting was three-fold:

  1. To hold a public hearing on and consider enactment of a proposed Amendment to the Township Zoning Ordinance of 1998, which would create a Unified Development Area zoning classification as an "overlay" district, define the types of uses permitted in the UDA District, and establish development standards for the various uses within the District.
  2. To hold a public hearing on and consider enactment of an amendment to the West Vincent Township Zoning Map, by which a tract of land containing approximately 307 acres of land known as The Hankin Tract, would be rezoned to the UDA Overlay District.
  3. To deliberate and take formal action on the application of West Vincent Associates, Ltd. for conditional use approval of its proposed development of the Hankin Tract as a multiple use development in accordance with the terms of the UDA regulations, including retail components, office components and residential components. The Board's action is based upon the formal record, which was made during the course of several hearings held pursuant to the application and commenced on September 16, 1998.

Mr. Brachwitz read the changes in the conditions of the Order granting conditional use approval in their entirety (Conditions 20, 22, 24, 27, 30 c.(i) and (ii), 30 d. (i) and (ii), 36, and 37; Condition 38 was removed). Public comments were received regarding public water, traffic impacts, open space areas, and density issues. Mr. Miller, Mrs. Perkins and Mr. Brachwitz commented on the West Vincent Associates, Ltd. application for the Hankin Tract and the formal action before the Board.

A motion was made by Mr. Brachwitz to adopt Ordinance No. 99-94, creating a Unified Development Area zoning classification, defining the types of uses permitted in the UDA District, and establishing development standards for the various uses within the District. The motion was seconded by Mrs. Perkins and carried unanimously.

Mr. Miller moved to adopt Ordinance No. 99-95, amending the zoning map by adding an additional zoning map entitled "Unified Development Area Overlay District", and designating the Hankin Tract as being within this District as shown on the map. The motion was seconded by Mrs. Perkins and carried unanimously.

Regarding the application of West Vincent Associates, Ltd., a motion was made by Mr. Brachwitz to grant conditional use approval for the proposed development of the Hankin Tract in accordance with the Findings of Fact, Discussion, Conclusions of Law and Conditional Use Order and subject to the Applicant's compliance with each of the thirty-seven conditions. The motion was seconded by Mrs. Perkins and carried unanimously.

There being no further business, the public meeting was adjourned at 7:55 p.m.
