Public Hearing:
A conditional use hearing for Lawrence J. Kanavy was called to order at 7:40 p.m. by Chairman Kenneth Miller. Others in attendance were Supervisors Zoë Perkins and Karl Brachwitz, Township Manager Allen Heist, and Township Solicitor Allan Greenwood. This hearing had been duly advertised and proof of publication received. Since the applicant, or a representative for the applicant, was not present, the hearing was postponed until his arrival. Chairman Miller explained that upon the applicant's arrival, the regular meeting would be adjourned on a temporary basis and the conditional use hearing reconvened.
Regular Meeting:
The regular meeting was called to order at 7:45 p.m.
Bid Opening:
As advertised for this date, bids were received and opened to sell to the highest bidder "as is" a 1989 Chevrolet Caprice. The following bids were received:

Motion by Mrs. Perkins, seconded by Mr. Brachwitz to award the sale of the vehicle to Kenneth Miller; the motion carried unanimously.
Minutes:
Unanimous approval was granted for minutes of April 5, 12, 19, and 29 with a motion from Mrs. Perkins and second from Mr. Brachwitz.
Reports:
Treasurer's Report - Mike Burnley reported the following account balances: General Fund, $142,023.77; State Fund, $95,026.67; Kimberton Sewer Fund, $10,257.70; Road Repair Loan Account, $53,931.09; St. Stephens Greene Water Fund, $8,600.95; St. Stephens Greene Sewer Fund, $27,263.86; and Township Building Construction Fund, $695,834.32.
Tax Collector - Received from Berkheimer Associates: Current Real Estate Tax, $22,467.40, Debt Service - Road Repair Loan, $23,091.68; and Earned Income Tax, $16,039.93. Received from Chester County: Real Estate Transfer Tax, $19,930.20.
Building Inspector's Report - In April, 13 building permits and 5 U&O's were issued and 26 inspections conducted; fees totaled $3,084.40.
Police - The Police Department responded to 87 calls during April. A new patrol unit has been received and placed in service. Several traffic details were conducted on various roads in the Township and citations were issued; traffic details will continue. Two subjects were arrested for attempted theft of a four wheeler from Eagle Cycle. Parents are reminded to teach their children proper use of the 911 system; during April, the Police Department responded to eight 911 hang-up calls. Several realtor sale signs were recovered; owners will be contacted to pick up signs at the Township garage. Mrs. Perkins mentioned she has received several telephone calls from annoyed and frightened residents regarding a stunt plane practicing maneuvers in the Birchrunville area; Zoë will contact the FAA.
Fire Companies - Ludwigs Corner Fire Company responded to 7 calls, Kimberton Fire Company to 1 call, and Ridge Fire Company to 1 call in West Vincent Township during April.
Solicitor's Report - Solicitor Greenwood reported working on the following: review of the revised Tenant Ordinance; St. Stephens Greene requirements prior to dedication of public improvements; and Cooks Glen Road, which due to possible litigation, will be discussed with the Board after the meeting in executive session.
Correspondence:
Chester County Department of Emergency Services is sponsoring Public Safety Day on June 12th, 1999 from 11:00 a.m. to 3:00 p.m. at the Government Services Center.
Subdivisions/Land Development/Zoning:
The Board acknowledged receipt of a Zoning Hearing Board application from Sam Coroniti, who owns Buttonwood Farms Lot #3 on Hollow Road. The applicant seeks a variance or any other relief necessary to permit construction of his home in such a way as to encroach upon the required 100 foot front yard set-back so as not to impact the Birchrun stream, which bisects the property. A hearing date has been set for Wednesday, May 26, 1999 at 7:00 p.m.
The Board also acknowledged receipt of a Zoning Hearing Board application from Paul and Shirley Pitcher, equitable owners of the Hadley property, French Creek Road. Variances are requested from the terms of Sections 1704.A.2, 1704.C[D], 2206.C2 and 2307 of the Township Zoning Ordinance to permit construction within the prohibitive slope district and from the required 50 foot wetlands vegetated buffer. An application for road occupancy permit was submitted to the Township.
Board Members reviewed the revised Tenant Ordinance, an ordinance requiring owners of accessory living quarters or dwelling units to notify the Township Office of the names of occupants and/or tenants; the ordinance will be advertised for adoption.
Motion by Mr. Miller, seconded by Mrs. Perkins, to authorize payment for Lyme disease vaccines for the Roadmaster and Road Crew. Motion carried with Miller and Perkins voting in favor; Brachwitz opposed.
The Pennsylvania Liquor Control Board has notified the Township of Daniel and Neil Grubb's application for a transfer/distributor license for their property located at 101 Cedar Lane. Mr. Grubb requested the Board's position on the license transfer. Due to a potential conditional use application and land development plan submittal, the Board stated no position on the license transfer at this time.
Tom Quinn, who has an agreement of sale on the Hompe property on Hilltop Road, and Jim Campbell were present to discuss with the Board a stabling operation planned for the 12 acre property and the definition of commercial use as it relates to this operation. Although Mr. Quinn's situation may not constitute a commercial operation, he was advised to seek conditional use to establish the record (i.e. hours of operation, number of horses per acre, waste removal, etc.).
Bills List:
Mrs. Perkins made a motion to pay the bills on the Bills List dated May 10, 1999; it was seconded by Mr. Brachwitz and carried unanimously.
At 8:25 p.m. the regular meeting was adjourned on a temporary basis and the Kanavy hearing reconvened. The Conditional Use hearing for Lawrence J. Kanavy was continued until Monday, June 14th, 1999 at 7:30 p.m. The regular meeting was then reconvened.
The Board will meet with Cathers & Associates, architect for the Evan's farm property, at the administrative meeting Monday, May 17th at 8:00 a.m.
There being no further business, Mrs. Perkins moved the meeting be adjourned; the motion was seconded by Mr. Brachwitz and the meeting adjourned at 8:30 p.m. An executive session was held regarding possible litigation matters.
