The regular meeting of the West Vincent Township Board of Supervisors was held on the above date at the Township Building. Chairman Kenneth Miller called the meeting to order at 7:40 p.m.; others in attendance were Supervisors Zoë Perkins and Karl Brachwitz, Township Manager Allen Heist, Township Solicitor Allan Greenwood, and William Handy, court reporter.
The regular meeting was opened to consider the Jon and Barbara Lines application for conditional use, which was received April 9, 1999. The applicants desire to use their property for auto repair, carpet storage warehouse, general merchandise storage, storage of parts and equipment, and equipment storage for lumber and/or plumbing supplies. A Public Hearing will be held Monday, May 24, 1999 at 7:30 p.m. It was suggested the McCurdy & Sons conditional use hearing be rescheduled to the same date as the Lines public hearing since both applications pertain to the same property. The Board unanimously acknowledged receipt of the conditional use application from Jon and Barbara Lines upon a motion from Mrs. Perkins and second from Mr. Brachwitz. The regular meeting was adjourned on a temporary basis and will reconvene following the McCurdy & Sons conditional use hearing.
Public Hearing:
A conditional use hearing for McCurdy & Sons was called to order at 7:45 p.m. by Chairman Miller. This hearing had been duly advertised and proof of publication received. Solicitor Greenwood read correspondence dated April 19, 1999 from Douglas B. Macbeth, attorney for Mr. McCurdy, requesting the Board to continue the hearing on Mr. McCurdy's application to the same meeting where Mr. Lines will be heard. Both applicants agree that a joint appearance would be in everyone's best interest. A follow-up letter dated April 23, 1999 was received from Douglas Macbeth confirming McCurdy & Son's waiver of any deemed approval or other similar argument should the Board agree to continue hearing on the application. A motion was made by Mr. Brachwitz to grant Mr. McCurdy's request for continuance and hold a joint hearing with Mr. Lines on Monday, May 24, 1999 at 7:30 p.m. The motion was seconded by Mrs. Perkins and carried unanimously. The hearing was adjourned at 7:48 p.m.

The regular meeting of the Board of Supervisors was reconvened at 7:48 p.m.
Bid Awards:
Motion by Mr. Brachwitz to reject all bids received for the St. Andrews Lane Box Culvert due to staff error whereby two bids received prior to the bid opening Monday, April 19th at 8:00 a.m. inadvertently were not presented for opening. Bids were received from the following contractors:

Mr. Brachwitz noted the Brown bid was incomplete due to the note regarding transport of equipment and employees. Bid conditions specify "costs and time incurred by the contractor to transport employees and equipment to the job site and personal transportation costs shall not be eligible for reimbursement by the Township". Motion by Mrs. Perkins, seconded by Mr. Brachwitz, to reject the bids submitted for Road Maintenance - Tree Removal/Trimming and re-bid; the motion carried unanimously.
Correspondence:
Manager Heist reviewed the following press releases from Chester County Health Department:
Correspondence was received from West Vincent Animal Control & Humane Society regarding an animal attack February 15, 1999 involving Bellwood Hunt Club's foxhounds and a family pet on the property of Mr. & Mrs. Liss. A public notification policy for West Vincent Township residents has been developed as follows:
As a result of an increase in roadway littering, a letter was received from Rose L. Fieo, a St. Andrews Lane property owner, requesting the Board to "consider posting "No Litter" signs along St. Andrews Lane with a severe monetary fine". Littering has become a township-wide problem; it was suggested residents be encouraged to pick up trash along their roadway. Mrs. Perkins noted that many Township residents feel the impact of signs along roadways is as great an impact as litter. A response will be sent to Mrs. Fieo advising her the Board is aware of the problem.
Subdivision/Land Development/Zoning:
An agreement for subdivision review extension to May 31, 1999 for the Hankin Tract (By-Right) was acknowledged with a motion from Mrs. Perkins and second from Mr. Brachwitz; the motion carried unanimously.
Hankin Conditional Use and Zoning Amendment Application - A public hearing, originally scheduled for April 29, 1999, has been rescheduled and will be held Wednesday, May 19, 1999 at 7:00 p.m. at the Ludwigs Corner Fire Company.
Gene Richards, representing Romeo Coscia, was present to review a revised preliminary/final Coscia Subdivision Plan, which included the addition of Note 19 "The private street is to be constructed to public street standards. The private street shall be constructed before issuance of the first building permit. No responsibility for road improvements shall be placed on the Township."; street maintenance note; street detail; and a Declaration of Private Street Easement Agreement. The applicant requests waivers from Section 611.H.4 (minimum length of a private street), Section 611.D.2a (minimum width of a private street) and Section 612.C.1 (sidewalks). The Planning Commission unanimously recommends approval of the subdivision. Mrs. Perkins moved that the three waiver requests be granted and subsequently approval of the Coscia Subdivision Plan conditioned upon Fronefield Crawford's satisfactory review of the Declaration of Private Street Easement Agreement. Solicitor Greenwood drafted the subdivision approval condition and Mr. Richards signed the agreement as agent for the applicant. Mr. Miller seconded the motion; the motion carried with Perkins and Miller voting in favor and Brachwitz opposed. Mr. Brachwitz stated he did not want to set a precedent of more than three lots on a private drive.
The Board acknowledged receipt of a preliminary subdivision plan for two lots on the 7.242 acre Shontz/Seibert property on Wyndemere Lake Drive - Lot 22 Cotswold Estates with a unanimous motion from Mr. Brachwitz and second from Mrs. Perkins. The plan will be distributed for review.
Unanimous approval was granted for the Municipal Park Escrow Release #3 in the amount of $26,716.28 to Greenway Servies Inc. upon a motion from Mr. Brachwitz and a second from Mrs. Perkins.
The Township Engineer has reviewed the Matthews Meadows Spray Site Landscape Plan and suggested additions/modifications were submitted. The spray fields are to be harvested to remove nitrates; Chairman Miller questioned if any shrubbery proposed would be toxic to animals. Manager Heist will contact the Township Engineer to examine this issue.
Upon recommendation from the EAC and Planning Commission, Mr. Brachwitz moved an update of the Township's Act 537 Plan for the Ludwigs Corner Area be pursued. The motion was seconded by Mrs. Perkins and carried unanimously.
Old Business:
A unanimous motion was made by Mr. Brachwitz, seconded by Mrs. Perkins, to authorize advertising an Ordinance and Resolution establishing the relationship between the West Vincent Land Trust, Inc. and the Township.
Mrs. Perkins questioned the expenditures for "Supervisors" and "Code Enforcement Officer" line items on the March Budget Report; the Township Treasurer will be consulted.
Township Resident Mark Dushanko asked the status of the Wetherill Estates Water System. The system is expected to be offered to the Township for dedication sometime this year.
New Business:
Motion by Mr. Brachwitz to renew the Traffic Signal Maintenance Contract with Signal Service Inc.; the preventive maintenance and relamping contract cost is $525.00. The motion was seconded by Mrs. Perkins and carried unanimously.
Bills List:
Mrs. Perkins made a motion to pay the bills on the Bills List dated April 26, 1999; it was seconded by Mr. Brachwitz and carried unanimously.
There being no further business, Mr. Brachwitz moved the meeting be adjourned; the motion was seconded by Mrs. Perkins and the meeting adjourned at 8:35 p.m.
