BOARD OF SUPERVISORS
MINUTES - MARCH 22, 1999
The regular meeting of the West Vincent Township Board of Supervisors
was held on the above date at the Township Building. Chairman Kenneth
Miller called the meeting to order at 7:35 p.m.; others in attendance
were Supervisors Zoë Perkins and Karl Brachwitz; Township Manager
Allen Heist and Solicitor Allan Greenwood.
Bid Award:
- Bid proposals were received March 15, 1999 for repair to an
existing culvert on Davis Lane and reviewed by Bob Flinchbaugh,
Alternate Engineer. The low bidder, Shainline Excavating, Inc. has
provided all information required and the bid proposal is considered
complete. Motion by Mr. Brachwitz to accept the bid from Shainline
Excavating, Inc. in the amount of $13,200.00 for Davis Lane culvert
repairs. The motion was seconded by Mrs. Perkins and carried
unanimously.
Correspondence:
- Anna May Houck, Chairman of the Board of Auditors,
reported the books of the Township Treasurer have been examined and
found to be in balance; all funds were correctly accounted for and
dispersed. The Annual Audit and Financial Report has been filed on time
with the Department of Community & Economic Development and the
Clerk of Courts.
- Manager Heist reviewed the following correspondence:
- TRC Environmental Corporation notified the Board
that Columbia Transmission Communications has applied to DEP for an
individual NPDES permit. The application was filed for minor earth
disturbances in conjunction with their fiber optics project along
existing pipeline right of ways.
- The Occupational Health Center will provide Lyme disease
vaccines at a cost of $68.00/dose; three vaccinations over a
one-year period are required for optimal protection. The Roadmaster and
Road Crew will be surveyed for interest and the Township insurance
carrier will be consulted regarding coverage.
- The Chester County Health Department offers free waste
assessments for qualified businesses to identify waste reduction
opportunities.
- The Chester County Library in Exton offers free
tours weekly to learn how the library functions and the services
available.
- Mr. Sandland, Transportation Coordinator for the Owen J. Roberts
School District, sent a letter requesting the installation of a
"Bus Stop Ahead" sign on the northbound lane of Route
100 in the vicinity of Cedar Lane and approximately 100 feet prior to
the crest of the hill for traffic traveling North. The Board authorized
Manager Heist to write a letter to PennDOT regarding the placement of
the sign.
Subdivisions/Land Development/Zoning:
- The Board unanimously acknowledged receipt of an agreement for
subdivision review extension to June 30, 1999 for EXXON
Corporation upon a motion from Mr. Brachwitz and second from
Mrs. Perkins.
- An agreement for subdivision review extension to April 30,
1999 for the Hankin Tract (By-Right) was acknowledged with
a motion from Mrs. Perkins and second from Mr. Brachwitz; the motion
carried unanimously.
- In response to a letter written by the Township last month (which
was a follow-up to a March 1998 letter) regarding the isolation area and
viability of Wetherill Estates' supply well #3, DEP has
advised that at the time the well permit was issued "a controlled
100 foot radius around the well was only a recommendation in the
community water supply manual. Drinking Water Regulations were amended
on July 1, 1995 to include a mandatory wellhead protection area for all
new community wells. A request to transfer the Wetherill system to the
township would not result in a mandatory wellhead protection area, as
this action does not involve new source construction."
- Correspondence was received from Southdown Homes and William J.
Burke, Esquire regarding a proposed Amendment to the Declaration
for Wetherill Estates, which would delete Lot 74 (1066 Bartlett
Lane) from the property subject to the Declaration. Areas of concern
included: the status of Lot 74 being deed restricted against further
subdivision, does the amendment invalidate the original calculations
used to gain subdivision approval, and existing easements on the
property related to the subdivision. Manager Heist and Solicitor
Greenwood will review the approved subdivision plans, the current
Declaration language, and the proposed amendment. The attorney for the
owners of Lot 74 is also reviewing the language of the amendment; the
proposed amendment may be subject to comment by them.
- A revised landscape plan for the Matthews Meadows Spray
Irrigation Field has been received; the plan shows an increase
in the evergreen screen and reduction in shrubs providing a greater
buffering effect. The Township Engineer and EAC will review the
landscape plan.
- A memorandum was received from the EAC and Planning Commission
requesting the Board to consider amendments to the Zoning
Ordinance regarding the voluntary placement of conservation
easements on open space/greenway lands and an amendment to the common
driveway requirements to allow lot frontage via easement (in addition to
street). During their April Work Session, the Planning Commission will
discuss an outline of potential amendments and Manager Heist will draft
the proposed changes prior to Fronefield Crawford' review.
- The Board unanimously acknowledged receipt of a conditional use
application from Lawrence J. Kanavy upon a motion from
Mr. Brachwitz and second from Mrs. Perkins; the hearing will be held
Monday, May 10, 1999 at 7:30 p.m. The applicant desires to use his
property for distribution, sales, and storage of building materials.
Old Business:
- Solicitor Greenwood has reviewed and approves the revised
agreement to change the taxing authority of Lot #8 Wyndemere Lake
Drive from West Vincent Township to Upper Uwchlan Township.
Mrs. Perkins moved that the Board of Supervisors be authorized to
execute an agreement authorizing the changing of West Vincent tax parcel
25-7-87.1A (Robert Gregory Property) to an Upper Uwchlan Township tax
parcel number under and subject to the stated conditions. The motion
was seconded by Mr. Brachwitz and carried unanimously.
New Business:
- Motion by Mr. Brachwitz to approve the purchase of a John
Deere F1145 Commercial Front Mower with 72" side discharge
deck and attachments totaling $15,985.33 through the state piggyback
contract. The motion was seconded by Mrs. Perkins and carried
unanimously.
- In response to a request from Camphill Village to hang an overhead
banner across a state roadway, a draft resolution was
prepared to authorize the erecting, maintaining and removing of
signs and banners. The resolution was reviewed and discussion
followed regarding permit procedures, proof of insurance, municipal
liability and enforcement; the resolution was tabled.
- The Board authorized Manager Heist to write a letter of support to
the Supervisors of Charlestown Township opposing the proposed
Turnpike Slip Ramp on Route 29. Board Members agree
interchanges may accelerate development, encourage more sprawl, and
adversely impact surrounding infrastructure.
- Upon a motion from Mrs. Perkins, second from Mr. Brachwitz,
unanimous approval was granted to request the Center for Local
Government Services to assist the Township Treasurer with computer
training to set up the Township accounts; there will be no cost
to the Township.
Business from the Floor:
- Pam Shillingford-Brown reported an unregistered, abandoned
vehicle in the vicinity of 1116 Jaine Lane. Manager Heist will
notify the Police Department and Code Enforcement Officer.
- Wheeler Aman questioned the $15,985.33 purchase price of the John
Deere mower and attachments. It was explained that the mower, which
will be used for the Township Park/Municipal Complex, was purchased
through the state piggyback purchasing program; this eliminates the need
for Township bid proposals.
Bills List:
- Mrs. Perkins made a motion to pay the bills on the Bills List
dated March 22, 1999; it was seconded by Mr. Brachwitz and carried
unanimously.
There being no further business, Mrs. Perkins moved the meeting be
adjourned; the motion was seconded by Mr. Brachwitz and the meeting
adjourned at 8:40 p.m.
