BOARD OF SUPERVISORS
MINUTES - MARCH 8, 1999
The regular meeting of the West Vincent Township Board of Supervisors
was held on the above date at the Township Building. Chairman Kenneth
Miller called the meeting to order at 7:40 p.m.; others in attendance
were Supervisors Zoë Perkins and Karl Brachwitz; Township Manager
Allen Heist and Solicitor Allan Greenwood.
Minutes:
- Unanimous approval was granted for minutes of February 8, 15, and
22 with a motion from Mr. Brachwitz and a second from Mrs. Perkins.
Reports:
- Treasurer's Report - Mike Burnley reported the following
account balances: General Fund, $120,052.27; State Fund, $5,989.49;
Kimberton Sewer Fund, $8,073.10; Road Repair Loan Account, $11,531.02;
St. Stephens Greene Water Fund, $7,699.49; St. Stephens Greene Sewer
Fund, $24,798.74; and Township Building Construction Fund,
$690,495.36.
- Tax Collector - Received from Berkheimer Associates:
Delinquent Real Estate Tax, $1,795.78; Debt Service - Road Repair Loan,
$1,427.29; and Earned Income Tax, $35,303.07. Received from Chester
County: Real Estate Transfer Tax, $9,759.89.
- Building Inspector's Report - In February, 8
building permits and 20 U&O's were issued and 28 inspections
conducted; fees totaled $2,520.00.
- Police - The Police Department responded to 60 calls
during February. The West Vincent Police are investigating several
nighttime burglaries in the area of St. Matthews Road and Route 40l.
Anyone with information should contact the Police at 935-2442. The
following are suggestions to residents for a safe community: secure all
doors and windows before going to bed; remove all keys from vehicles;
keep exterior lights on outside your residence; notify the Police
Department of any suspicious person or vehicles in the area; if
possible, set your alarms prior to going to bed or leaving your
residence; and notify a neighbor or friend when leaving on vacation or
extended period of time.
- Fire Companies - Ludwigs Corner Fire Company, 3
calls in February.
- Solicitor's Report - Solicitor Greenwood reported
working on: the Police Pension Plan Agreement; Ordinance 93-1999,
enrolling full-time Police Officers in PMRS; and Ordinance 92-1999,
restoring Schoolhouse Lane as a two-way street.
Correspondence:
- Correspondence was received from Suburban Cable
notifying the Township of an increase in monthly Basic and
Basic/Standard prices effective April 1999. Also, effective April 1,
1999, Disney Channel will become part of the Standard tier of
service.
- Pam Shillingford-Brown, EAC Vice Chairperson, reported Larry and
Celeste Liss contacted her regarding a recent incident when a pack of
foxhounds attacked and killed a family pet. The EAC is responsible for
trails protection in the township and fears incidents of this nature
will cause landowners to deny access to their property. In response to
the incident, a letter was drafted for the Boards review, to the Master
of Foxhounds of three local hunt clubs requesting the
Hunts to offer solutions and to indicate what course of action will be
taken to insure the hounds are under control. Russell Mosteller, Master
of Foxhounds of Bellwood Hunt Club, was present and stated that he has
spoken with Mr. and Mrs. Liss regarding the tragic and unfortunate
incident; the Hunt Club is responding to their concerns and is willing
to listen to any suggestions. The Board agreed this is a private
property issue, not a Township issue, and advised against sending a
letter at this time.
Subdivisions/Land Development/Zoning:
- Michael Matlock was present to review a five-lot,
Tier 2 sketch plan for his 18.293 acre property located at Flint and
Kimberton Roads and to request a waiver to construct a 10' wide private
street. The plan will be revised to relocate the cul-de-sac onto Lot 4
and add a 50' access to Lot 5 to alleviate flag lot status. Supervisors
Brachwitz and Perkins indicated a non-binding inclination to favorably
consider the waiver request and Mr. Miller refrained from comment.
Old Business:
- As a follow-up to Wheeler Aman's question last month regarding
acceptance of dedication of the Kimberbrae Trail Easement,
the West Vincent Land Trust has requested the Board to inform
Kimberbrae landowners, whose property traverses the "Kimberbrae
Trail", that the Land Trust has the capability to accept dedication
of the trail. The request was tabled until March 15th, when
a joint meeting will be held to discuss the Township's relationship with
the Land Trust and the various tax classifications under Section 509;
the Board will then take direction from the Land Trust regarding their
request.
- Manager Heist reviewed the four proposals for architectural
services submitted for the proposed Township complex. Bids were
received from the following firms:

The Township Engineer recommended narrowing the field to two
firms, Cathers & Associates and G.J. Donovan & Associates,
interview them, and consider negotiating to lower or better define the
construction administration services. Mr. Brachwitz reviewed the
proposals and concluded Cathers & Associates had the best scope, a
better understanding of what the project involves, and realistic costs.
Mrs. Perkins noted between the recommended firms, her preference was
Cathers & Associates, a local firm (Malvern versus Doylestown) at a
significantly lower cost. The Board authorized Manager Heist to open
negotiations with Cathers & Associates, Inc. and proceed in the
preparation of a contract. Harry Archinal suggested that the Board does
not cut back on design fees for the pre-engineered metal maintenance
building; design time will be needed for the structure to fit
complimentary to the style and views of the Township complex.
- With a motion from Mr. Brachwitz and a second from Mrs. Perkins,
unanimous approval was granted for adopting Ordinance
92-1999, which repeals Ordinance 90-1999 and re-establishes
Schoolhouse Lane from Flowing Springs Road to Hollow Road as a two-way
street.
- A motion was made by Mr. Brachwitz to adopt Ordinance
93-1999, enrolling all full-time police officers in the PA
Municipal Retirement System; the motion was seconded by Mrs. Perkins and
carried unanimously. Solicitor Greenwood indicated Ordinance 92-1999
and Ordinance 93-1999 were duly advertised, as required, in the Daily
Local News and proof of publications were received.
- Manager Heist, Solicitor Greenwood and Jim Allen, representing the
PA Municipal Retirement Board, have reviewed the West Vincent
Township Police Pension Plan Agreement; both parties are
satisfied with the agreement. Motion by Mr. Brachwitz to enter into
agreement with the PA Municipal Retirement Board to establish a police
pension plan for all full-time police officers effective the first day
of October, 1998. The motion was seconded by Mrs. Perkins and carried
unanimously.
New Business:
- Manager Heist reviewed a request from J. Bruce Schelkopf,
representing Robert Gregory, owner of Lot #8 Wyndemere Lake Drive, to
change the taxing authority of the property from West
Vincent Township to Upper Uwchlan Township. The approved subdivision
plan shows the Township line through the middle of the lot and the owner
would like to build on the Upper Uwchlan portion of the property.
Currently the lot is being treated as a West Vincent parcel. There was
concern regarding what would happen if the residence were constructed in
West Vincent Township, since this issue is not addressed in the
agreement. The Board will table their decision on the proposed
agreement to allow time for Solicitor Greenwood to speak with the Chief
Assessor of Chester County, review the agreement and submit a letter to
the Board with his recommendations.
- Chester County 2020 will be held Thursday, April
22nd, 4-7 p.m. at the East Senior High School, West Chester.
Allen Heist, Zoë Perkins, Pam Shillingford-Brown (EAC), Jane Gaffer
(Zoning Hearing Board) and a Planning Commission representative were
given authorization to register for the conference.
Bills List:
- Mrs. Perkins made a motion to pay the bills on the Bills List
dated March 8, 1999; it was seconded by Mr. Brachwitz and carried
unanimously.
There being no further business, Mrs. Perkins moved the meeting be
adjourned; the motion was seconded by Mr. Brachwitz and the meeting
adjourned at 8:40 p.m. An executive session dealing with personnel
matters followed the public meeting.
