PLANNING COMMISSION MINUTES
November 15, 1998
ATTENDING: Chairman James Wendelgass Members Wheeler
Aman, Kate Damsgaard, Vince Kling, Joan Michaelson, and Jean Warrick;
and Township Manager Allen Heist.
Chairman James Wendelgass called the meeting to order at 7:35 p.m.
The following correspondence was reviewed:
- Evans Mill Environmental, Inc. - Mrs. Parke is
proposing to continue use of a sewage holding tank on a permanent basis
and amending the current agreement with the Township.
- Chester County Water Resources Authority - pursuing
a Keystone Rivers Conservation Plan Grant from the PA Department of
Conservation and Natural Resources to obtain additional funds for
developing a County-wide comprehensive watershed and water resources
management plan.
- PSATS - Act 93 of 1998, which takes effect on
December 14, 1998, amends the state Sunshine Law to require an
opportunity for public comment before taking official action at a public
meeting.
- Upper Uwchlan Township has submitted a copy of the
Township Official Map for the Route 100 Corridor and proposed ordinance
establishing and adopting the Official Map of the Route 100
roadways.
- Chester County Planning Commission is hosting
several public workshops on transportation issues in preparation of a
comprehensive transportation plan for Chester County,
"Connecting Landscapes". Local workshops will be held
Tuesday, December 8, 7:30 - 9:30 p.m. at the Lionville Middle School and
Thursday, December 10, 7:30 - 9:30 p.m. at the Owen J. Roberts Middle
School.
Robert Canace, Geoscience Services, was present to discuss basic
groundwater resource principles and the practical
implementation of hydrologic concepts and review the recommendations
made regarding the GVA Sustainable Watershed Study. In conclusion, Mr.
Canace commented on the significance of the Township's current water
resource-related codes as follows:
- Issue: Residential lot size for rural areas served by
wells and septic systems should have density appropriate to maintain
stream base flow and groundwater quality.
- Action: Use results of the water balance model and
nutrient models to support present zoning. Develop basis and background
documents for technical justification of zoning.
- Status: Appropriate zoning appears to be in place.
Additional technical justification may help avert future legal
challenges and place the Township in a superior legal position.
- Issue: Maintain stream flow by reducing consumptive losses
due to development.
- Action: Develop design and performance standards to offset
consumptive losses, such as those associated with wastewater treatment.
Establish Best Management Practices to control stormwater run off and
encourage groundwater infiltration. Promote infiltration basins to
capture runoff and increase groundwater storage. Develop landscaping
design standards to lessen irrigation standards. Develop water
conservation standards for plumbing.
- Status: The Township has developed stormwater management
requirements that include retention of groundwater recharge in basins.
Design standards for drought-tolerant landscapes and water-saving
plumbing may be needed.
ZONING:
The joint work sessions to review the West Vincent Township
Zoning Ordinance and Subdivision and Land Development
Ordinance have been completed. A public hearing will be held by
the end of the year to receive comments on the final draft
ordinances.
SUBDIVISIONS:
A sketch plan was submitted by Michael Matlock for his
48.35 acre property located at Flint and Old Kimberton Roads in the R-2
Zoning District. It was suggested Castle Valley Consultants be
contacted to submit a topography map and aerial photograph of the
property to provide a basis for a site analysis plan. A site visit will
be scheduled following receipt of this information.
James Fasel and Lisa DiAndrea, Medveczky Associates, reviewed a
revised sketch plan for the Fasel property, 1245 School
House Lane. The 36.42 acre farm is divided into four residential lots:
the existing farmstead with 20.5221 acres and remaining lots of
approximately five acres. The property includes a PECO easement and a
100' wide gas easement. On site water and sewer are proposed; the
five-acre lots will be deed restricted against further subdivision. The
Planning Commission suggested the applicant consider increasing the
frontage of Lot 3, a rectangular shaped lot approximately 1,000' deep
and a width of 160' along the roadway to 225'.
Eric Frey, Esquire and Joe Baron, Bohler Engineering, Inc. were
present to discuss the Chester County Planning Commission and Castle
Valley Consultants, Inc. review letters on the Exxon
Corporation land development plan. The following issues and
concerns were discussed:
- Access and Circulation:
- The applicant agreed to show ultimate right-of-ways.
- The requirement for a Highway Occupancy Permit will be noted on
the final plan
- The applicant will provide documentation that sufficient area
will be available to accommodate the internal turn movements of gasoline
tanker trucks.
- Verification that the proposed access points have adequate sight
distance is needed.
- Concerns were noted regarding the entrance-only driveway located
on Rt. 100
- Stormwater Management:
- The applicant has submitted the E&S plan to the Chester
County Conservation District for verification.
- The recommended E&S notes will be added to the plan (per CVC
10/12/98 Memo)
- The applicant will consider the need for oil/water separators at
the catch basins.
- Limits of clearing around proposed disturbance will be shown on
revised plan.
- Screening:
- The landscape plan was prepared based on the zoning ordinance;
the applicant will consider supplemental screening in the open area
designated for the septic system.
- Lighting:
- The applicant intends to comply with illumination level zoning
requirements.
- Waiver:
- The applicant is requesting a waiver with respect to the
location of a driveway edge; placement would be approximately 60' north
per the ordinance.
- Are there other angles of alignment that would enable drivers to
readily access the fueling stations without having to enter so close to
the intersection?
- General Comments:
- Add the road number for Birchrun Road on the plan (SR 1030)
- The applicant will consider provisions for an internal road
connection linking this site with the Hankin Tract.
- Site analysis plan will be submitted.
- Sewer and water feasibility and hydrogeology reports will be
submitted.
- Water supply information will be submitted.
- Chester County Conservation District approval needed.
- Chester County Health Department approval needed.
- Review of Traffic & Planning Design's letter dated November
19, 1998 needed.
David Beideman, Beideman Associates, was present to review the
Mary Louise Schreiner subdivision plan and request
approval recommendation. Motion by Vince Kling, seconded by Kate
Damsgaard, to recommend approval of the Schreiner subdivision plan
conditioned upon: submission of a site analysis plan; verification that
all proposed access points on Hilltop Road have adequate sight distance;
waiver of the hydrogeology study; and consistency with Castle Valley
Consultants, Inc. and Chester County Planning Commission review letters.
The motion carried unanimously.
With a motion by Vince Kling, second by Jean Warrick, the Planning
Commission unanimously recommended the Board of Supervisors turn down
The Hankin Group's proposed UDA in favor of the pending Township Zoning
Ordinance - each parcel in compliance with the zoning requirements for
the zoning district. Also discussed were water and sewer issues
regarding The Hankin Group alternate plan. A motion was
made by Jean Warrick to recommend to the Board of Supervisors the site
sustain itself regarding water and sewer. The motion was seconded by
Joan Michaelson; Damsgaard, Kling, Michaelson, Warrick, and Wendelgass
voted in favor; Aman opposed.
Membership terms expire December 31, 1998 for Jim Wendelgass and Joan
Michaelson, at which time Joan will be retiring her many years of
service on the Planning Commission.
The minutes from the October 15, 1998 meeting were amended by
striking "Members deemed the changes to the Exxon Land Development
Plan were not substantially different." (page 4, paragraph
three) and were unanimously approved as corrected with a motion from
Vince Kling and second from Joan Michaelson. The meeting was adjourned
at 11:20 p.m.
