The regular meeting the Board of Supervisors, held in the Township Building, was called to order at 7:38 p.m. by Chairman Kenneth Miller; others in attendance were Supervisors Zoe Perkins and Karl Brachwitz, Manager Allen Heist, and Solicitor Allan Greenwood.
Chester County Health Department - Manager Heist reported on a special promotion in the form of coupons worth $25 toward the purchase of a compost bin to the first 400 residents who register and attend a free backyard composting workshop. Workshops will be held in 4 locations during October.
Borst - On a motion from Mr. Brachwitz and a second from Mrs. Perkins, the Board acknowledged receipt of a 2-lot subdivision of 13.4 acres on Black Horse Road; the motion carried.
Hankin - Hearing dates for continued hearings on the Conditional Use/Zoning Challenge have been set for October 5 and 21, to be held at the Township building at 7:00 p.m.
Taylor Conditional Use hearing - This hearing had been set for October 12, but due to 1) a conflict with the Green Valleys Association annual meeting, at which Morrison Huston will be honored and 2) inability of some witnesses invited to attend on that date, a request was made to have the hearing date changed to October 26. The Board approved this change subject to Mr. Taylor's agreement.
Pyle - Mrs. Perkins noted that Lewis and Sarah Pyle have donated development rights to their 65-acre farm on Fellowship Road to the state-sponsored Agricultural Land Preservation Program in Chester County. A formal celebration will take place on the Pyle farm at 1:30 p.m. on October 6, to which the public is invited. Mrs. Perkins will pen a letter of commendation from the Board to the Pyles.
St. Stephen's Greene - Mrs. Perkins asked about the status of the basin #2 reconstruction. Some initial work has been started, no payment has yet been received, and the Township Engineer has not been contacted regarding this additional work. According to an agreement dated September 8, 1998, work was to be started and completed on specific dates, with per diem penalties if the deadlines were missed. Solicitor Greenwood reported contact with Morgan's attorney; no response has been received as yet. Solicitor Greenwood and Manager Heist will follow up.
Huntview @ Horseshoe Trail - Mrs. Perkins noted receiving a copy of a request from the Township Engineer to Mr. Emma to restructure the entrance to Huntview because of difficulty for fire trucks to enter the subdivision. Mr. Emma has verbally refused to make any changes. Manager Heist was authorized to send a letter to Mr. Emma, with copies to all homeowners, requesting his cooperation for the sake of his buyers' safety. Since this plan was approved with a private road, the Township has no legal authority to enforce changes.
Police - Since Officer Karl Jones will begin his full-time position with West Vincent on October 1, 1998, transfer of his police pension from East Coventry Township will be necessary. This item will be handled at the next meeting; information was not received until late today and has not been reviewed by the Manager or Solicitor.
PennDOT - On Friday, October 2 there will be a site inspection at the Rts. 401/100 intersection to consider what additional improvements are needed since the completion of Ludwigs Village's improvements. Included in this inspection will be PennDOT, Board members, Manager Heist, and Susan Walters from the Township's traffic planner.
Township Building Relocation - Manager Heist requested direction from the Board since an agreement of sale has been signed with the Evanses. Evans Mill testing and financing options for the purchase and renovation/building additions totaling $750,000 will be his focus for now. At their workshop session on Monday, October 5 Board members will discuss renovation/building plans.
Animal Control - Mr. and Mrs. Richard Deforno, Kimberton Road residents, were present to discuss their concerns regarding animal control in the Township following a difficult experience involving a dog on their property. Bob Yarnall, Jr., who is the Township Animal Control Officer, was also present to answer their questions and relieve their concerns as he explained the procedures used when he is called for assistance. The problem appears to have resulted from an incorrect phone number provided to the Defornos.
S.P.C.A. - Annual appeal for participation. No action was taken.
Kimberton Sewer Project - Mr. Brachwitz asked for an update on the Miskos, whose sewer payments are in arrears. Several contacts have been made, both in writing and by phone, with no response. Solicitor Greenwood suggested attaching a lien on the property; he will begin that process.
Safety issues at intersections - David Kusner reported his concern for clear sight lines at intersections where farmers have planted their crops too near the road (Rt. 100/Fellowship Road, Flint Road/St. Matthews Road). Manager Heist said he would check Flint Road and St. Matthews Road. Rt. 100/Fellowship Road is located in Upper Uwchlan Township.
Proposed Ordinance - Solicitor Greenwood was given authority to advertise a public hearing for adoption of BOCA Plumbing and Building Codes.
Mrs. Perkins made a motion to pay the bills on the bills list dated September 28, 1998; it was seconded by Mr. Brachwitz and carried unanimously.
