MINUTES - September 8, 1998
Combined workshop for update of Zoning and Subdivision Ordinances

PLACE OF MEETING: Township Building meeting room
TIME OF MEETING: 7:30 p.m.
PURPOSE OF MEETING: Workshop meeting to discuss proposed changes to draft ordinances.

The meeting was called to order at 7:40 p.m. by Chairman Kenneth Miller and then turned over to Manager Heist, who proceeded with proposed changes from the point at which the last meeting ended.

2102A.1. (Parking)
Allows Board of Supervisors discretion.
Will remain.

2102F. (Parking)
Revise parking requirements per TPD letter of 6/3/98.
Board agreed.

2102G. (Parking)
Allows Board of Supervisors discretion.
Will remain.

2106B.1.a.(2) (Screening)
Base screening applicability on density, not total number of units.
Will be reworded to read: All residential subdivisions or developments with lots of 1 ac. or less per dwelling unit.

2108 (Lighting)
Revise based on lumens (vs. Footcandles), angle of lighting source, etc. Revise/expand per Craig Hannafin memo received 6/24/98.
Will be revised per above memo and sent to the Township Engineer for review.

2108B.7. (Lighting)
Add provision requiring that any lighting where canopies are permitted shall be recessed entirely into the ceiling of such canopies or entirely shielded or hooded to the full extent such lighting protrudes below the canopy.
Will be added.

2108B.8. (Lighting)
Add provisions requiring that a manufacturer's light distribution pattern be submitted for any pole or mounted light fixtures.
Will be added.

2108D.1. (Residential Lighting)
Replace with limits to the level of illumination at the property line.
Will be revised per Craig Hannafin memo (see 2108 above).

2205 (Film & Video)
Delete or revise.
After a lengthy discussion, will remain as is.

2208 (Group Homes)
Expand per East Vincent Township Zoning Ordinance provisions.
Will be expanded.

2209B. (Home Occupation)
Define "tourist homes" Vs "bed & breakfast".
"Tourist homes" will be deleted.

Article XXII (Trails)
Add section on trails to reference Section 616 of SLDO.
Section 2228 will be added.

2213H. (Performance Standards)
Change "radio" to "electromagnetic radiation". Reference federal NRC and state regulations for radioactivity and FCC for electromagnetic radiation from communication towers.
Will be revised per above.

2215 (Pipeline Setback)
Expand to include "no activity or grading within the pipeline right-of-way or setback area shall create depressions or areas in which flammable or explosive materials may collect or accumulate".
Will be expanded per above.

2220A. (Standards for Raising Animals)
Clarify definition of "pasture" (e.g.-excluding areas devoted to buildings & parking, wetlands, slopes over 25%, etc.).
Will remain as is.

2220B.2. (Standards for Raising Animals)
Revise minimum lot size required for raising horses as an accessory residential use from 2 acres per horse to "two (2) acres for the first horse and one (1) acre for each additional horse".
Will be revised.

2223 (Timber Harvesting/Logging)
Add "any existing trails or water courses may not be blocked, disturbed, or destroyed due to any logging activities". Add clean-up standards.
Will remain as is.

2224 (Towers)
Revise per Nextel letter of 6/10/98.
Proposed revision to Section 2224A. not necessary due to Nextel testimony at ZHB hearing 8/18. Section 2224B.8. will be revised to show tower height limitation of 150'. Section 2224B.9. will remain as worded.

2305 (Wetlands)
Verify consistency with Section 702B. and C. of SLDO.
Will be cross-referenced with SLDO.

2305C. (Wetlands)
Allow use of existing public data for wetlands delineation unless an on-site field assessment is deemed necessary by the Township.
Will be revised to reflect above.

2306 (High Groundwater Areas)
Verify consistency with Section 702B. of SLDO.
Will be cross-referenced.

2307 (Stream & Wetlands Buffers)
Verify consistency with Section 702C. of SLDO.
Will be cross-referenced.

2308 (Fill & Land Grading Activities)
Verify consistency with Section 705 of SLDO.
Will be cross-referenced.

2505C. (TDR)
Reduce maximum development capacity in Kimberton Village (Residential Mix) and Village Center Residential Districts. Prepare "build-out" map.
Will require further consideration.

2601C.2. (Nonconforming Uses)
Insert "total" prior to "...area devoted to the ..." Reword to avoid individual increases less than 50% which incrementally may result in a total increase over 50%.
"Total" will be inserted.

2602A. (Nonconforming Buildings)
Reword to avoid individual increases less than 50% which incrementally may result in a total increase over 50%.
Will be reworded.

2803B. (Special Exception)
Add "under the provisions of this Ordinance" to the end of last sentence.
Will be added.

The meeting adjourned at 9:30 p.m. Next scheduled workshop is for Wednesday, September 30 at 7:30 p.m.
