BOARD OF SUPERVISORS
MINUTES - July 13, 1998
The regular meeting of the Board of Supervisors, held in the Township
building, was called to order at 7:39 p.m. by Chairman Kenneth Miller;
others in attendance were Supervisors Zoe Perkins and Karl Brachwitz,
Manager Allen Heist, and Solicitor Allan Greenwood.
MINUTES
- Unanimous approval was granted for the minutes of June 8, 12, 19,
and 26 regular meetings, as well as minutes of the June 1 and 15 public
hearings. This came from a motion from Mr. Brachwitz and a second from
Mrs. Perkins.
REPORTS
- Treasurer - Mr. Burnley reported: General account
balance, $386,979.69; State account balance, $97,105.77; total,
$484,085.46. Kimberton sewer account balance, $11,265.79. Road repair
loan account balance, $33,397.85.
- Tax Collection - Received from Berkheimer
Associates: Current real estate tax, $3,435.65; delinquent tax &
penalties, $721.29; road repair loan, 5,169.37; earned income tax,
$79,099.94; total, $88,426.25. Received from Chester County real estate
transfer tax, $5,845.04.
- Building Inspector - 20 building permits issued, 16
plans reviewed, 44 inspections, and 7 U&O permits.
- Zoning Officer - 3 building inspections, 11 permits
reviewed, 10 zoning projects.
- Police - 1 traffic accident, 3 suspicious vehicles,
7 storm related calls, criminal mischief, trespassing, theft, 3 9-1-1
calls, recovery of money and credit cards, and 23 sounding alarms (many
from storms).
- Fire companies - Ludwigs Corner: 12 calls;
Ridge: 0 calls in West Vincent.
- Solicitor - Worked on escrow release for St.
Stephen's Greene storm basin #2 and purchase of the Evans property.
- Planning Commission - June 18 meeting:
Correspondence, preview of public hearing on the Subdivision Ordinance,
discussion on Mrs. Parke's sewage problem, the Polay court appeal,
Nextel Communications zoning hearing, subdivisions: Brown, Hankin,
Matthews Run (now Springlea), Pronsky, Fraley, Sheeder Mill.
- Environmental Advisory Council - July 6 meeting:
Discussed the combined meeting to be held on July 20 regarding the
Zoning and Subdivision Ordinances update, regional Household Hazardous
Waste collection for July 11, correspondence, reports, ZHB issues, the
proposed land trust, Parke's sewage problem, Polay's court appeal, dust
control application, and subdivision issues.
CORRESPONDENCE
- PA Historical & Museum Commission - Notice was
received that the Township Highlands Historic District was listed
in the National Register of Historic Places on May 7, 1998.
- PennDOT - Notice was received that the audit of
the 1997 Township Liquid Fuels Tax Fund was conducted and found
acceptable.
SUBDIVISIONS
- Hankin - Tentative dates for the Conditional
Use/Zoning Amendment hearing are set for August 12 and September 16.
- Polay - Michael Polay and his attorney David Malman
addressed the Board regarding their appeal from the decision of the
Board to deny Mr. Polay's request to remove spring water from his
property on St. Andrews Lane for sale commercially. Mr. Malman
reiterated the reasons why the Board might want to reverse their
decision. They requested an opportunity to discuss a settlement
in order to protect the Township from an unfavorable decision and to
offer a percentage of future revenue from the sale of spring water to be
used for maintenance of St. Andrews Lane. Mr. Miller made it clear that
the Board was fully aware of the potential risk involved when they
denied the request, but they will discuss with their attorney the
possibility of holding a public meeting regarding a possible
settlement.
OLD BUSINESS
- Dust control for gravel roads - A second coat of
Pennzsuppress will be applied this week to the roads
previously treated.
- Township Park - Manager Heist reported that he had
reviewed plans and would be sending them to the County for review
by the end of the week.
- Evans property - Regarding possible purchase
of the property for a Township building site, a non-binding poll is
being taken of the property owners in Matthews Meadows to get their
opinion on this use. Their Homeowners Association document limits all
lots in the subdivision for residential use. In order to continue the
option of buying the farm for Township purposes, a positive vote of 2/3
of the eligible owners is necessary to effect an amendment to the
Declaration of Covenants, Easements and Restrictions. Berman
Development Corp. is owner of 22 lots. Responses are being received and
will be evaluated. Solicitor Greenwood is looking into the possibility
of obtaining title insurance. The next step will be to hold a meeting
with the Homeowners Association.
- Kimberbrae trail - Wheeler Aman asked the Board to
revisit the issue of the public trail which appears on approved
plans for Kimberbrae, but which has never been opened. He has had some
tresspassing on his property and believes that opening the trail would
eliminate it. Judith Adams stated that her daughter must ride on roads
to get to her lessons on St. Matthews Road and would also like to see
the trail opened. A discussion ensued regarding provision of trails
with no destination and no mechanism in place to care for them, which
are sensitive issues. The Township is now pursuing a means to allow
trails to be Township owned and managed. Board members will look at the
issue again and attempt to come to a final decision.
- Household Hazardous Waste collection - Pam Brown
reported that the collection was well organized and seemed to be well
attended. John Hoekstra reported that 350+ people had responded and
approximately 45,000 lbs. were collected.
- St. Stephen's Green escrow for basin #2 - Mr. Miller
noted that there have been 2 or 3 scheduled starts, but no work has been
done as yet. Mr. Greenwood has put the bank on notice that the Township
may draw from the escrow account for this work. Morgan Bros. has stated
that they will do the work themselves. In the meantime, cost estimates
will be requested from Robert Fetters Jr. by Friday.
NEW BUSINESS
- Signal Service has notified the Township that
pavement markings need to be repainted at the Rt. 100 and 401
intersection as required by the Township's PennDOT permit for the
traffic light. No action was taken since the intersection is
presently undergoing construction related to Ludwigs Village. Pavement
markings will probably be needed as a result of the new construction.
BILLS LIST
- Mrs. Perkins made a motion to approve the bills on the list dated
July 13, 1998; it was seconded by Mr. Brachwitz and carried unanimously.
There being no further business, the meeting adjourned at 9:00 p.m.,
after which an executive session was held regarding an employee
matter.
