ENVIRONMENTAL ADVISORY COUNCIL
MINUTES - JULY 6, 1998
(UNAPPROVED)
ATTENDING: Chairperson Pam Brown, Members Jan Beale,
Craig Hannafin, and Ginny Wright; Board liaison Zoe Perkins; and
Planning Commission liaison Jim Wendelgass.
The Chairperson called the meeting to order at 9:45 a.m. Minutes
from the June 1, 1998 meeting were approved.
ADMINISTRATIVE:
The EAC, Planning Commission and Board of Supervisors will hold a
joint work session on Monday, July 20, 1998 at 7:30 p.m.
to review the Zoning Ordinance and Subdivision and Land Development
Ordinance public hearing comments.
Jim Wendelgass reviewed a letter written by The Hankin Group to
Philadelphia Suburban Water Company advising the water company of their
proposed development and projected water use and requesting a letter
indicating whether or not the water demand can be accommodated. It was
agreed, public water is a good alternative for this specific site;
however, there are concerns regarding the limited area for stormwater
treatment, the impact created by additional water and the water recharge
issue. Zoe Perkins mentioned The Hankin Group has submitted a
conditional use application and an application for amendment to the
Zoning Ordinance ("Unified Development Area District"); the
Board of Supervisors has been requested to hold a public hearing for
this application.
Also, the Board is conducting a preliminary survey of all lot owners
within Matthews Meadows to assess their initial opinion on the Township
use of the Evans’ property.
MAIL:
- Chester County Health Department – Regional Household
Hazardous Waste Collection Event will be held July 11 at the
Owen J. Roberts High School from 9 a.m. to 3 p.m. Volunteers are needed
at the site for internal traffic control, survey participants and help
maintain general order. Since West Vincent Township is a participating
municipality, there will be no charge to Township residents bringing HHW
to the collection event.
- DEP - Mrs. Loftus, Conestoga Road, was notified the
compounds associated with gasoline contamination were identified in the
water collected from the holding tank, prior to the filtration system in
place at her residence. (The filtration system on the well appears to
be adequately removing the gasoline contamination from the water.) DEP
is currently investigating the possible sources for this contamination.
The former owner of Cullens Country Cupboard 2 and the Exxon Company,
U.S.A. have been requested to submit well survey data, no later than
September 4, 1998, to assist in the effort to determine the source for
the contamination discovered at neighboring properties.
- Chester County Health Department - Robert Mosteller,
Jaine Lane, was notified of sewage violations.
- Cook Property, Sheeder Mill Road - The Township was
notified of clear cutting of trees and brush on the property. A copy of
regulations regarding the clear cutting of trees was sent; the owner was
advised to contact the Conservation District to discuss acceptable
control measures.
- PA Historical and Museum Commission - The West
Vincent Highlands Historic District was listed in the National Register
of Historic Places on May 7, 1998.
- Chester County Conservation District - A site
inspection of the Darlington pond revealed concerns regarding the trees
planted on the pond berm and seepage and piping along the pond berm. A
joint inspection with the Conservation District, DEP and the Township
will be scheduled.
- Chester County Conservation District - The plan for
the Kochensky pond construction has been reviewed and found adequate.
- Realtors Southeast Regional Public Affairs
Department - Suggested language addressing real estate
directional signs for incorporation into the Zoning Ordinance was
submitted.
REPORTS:
- St. Stephens Greene: Corrective action has not been
completed to rectify the problems with stormwater basin No. 2; the
slopes of the basin are less than the approved design and recommended
standards and trees left in the basin berm during construction have
hindered compaction.
- Township Park: The Township Engineer is revising the
plans and bid specifications for the Township Park based on the Chester
County Parks and Recreation Department review.
- Trails: The Trail Subcommittee's work on the
Township Trails Map/Narrative has been put on hold until completion of
the Zoning Ordinance and Subdivision and Land Development Ordinance
review.
OLD BUSINESS:
- West Vincent Township Zoning Ordinance and Subdivision and
Land Development Ordinance: Craig Hannafin reviewed her
memorandum to the Board of Supervisors regarding Section 2108 - Lighting
and the need to address the problem of uplighting (any
light source that distributes illumination above a 90° horizontal
plane). Also included were a copy of an outdoor lighting ordinance
adopted by Branford, CT and a model ordinance template designed by the
Illuminating Engineering Society of North America. The EAC also
discussed the references in the proposed Zoning Ordinance to the
West Vincent Township Historical Commission; since a
Historical Commission has not been appointed, it was suggested the EAC
be designated as this advisory board to deal with the matters pertaining
to any of the identified cultural and historic resources and administer
any historic preservation provisions as issues arise.
- The Zoning Hearing Board met Tuesday, June 17, 1998 to consider
the application of Nextel Communications for construction
of a 180' monopole tower; the application was coupled with a challenge
to the validity of the Zoning Ordinance. The applicant requested a
continuance which has been scheduled for Tuesday, August 18, 1998 at
7:30 p.m.
- Application has been made for tax exemption status designation and
incorporation of the West Vincent Land Trust Inc.; the
paperwork will be finalized in six months to one year.
- As a result of the ongoing problems at the Helen Wade Parke
property, the Township has been requested by the Chester County
Health Department to oversee the temporary pump and haul system; a
Sewage Holding Facilities Agreement and escrow account have been
finalized.
- Michael and Janet Polay have filed a zoning appeal
to the Court of Common Pleas, appealing the decision of the Board of
Supervisors denying the Polays' curative amendment challenge to the
validity of the Township Zoning Ordinance.
- Parts of Jaine Lane, Davis Lane, Dewees Lane, and the dirt portion
of Black Horse Road and St. Andrews Lane were treated for dust
control last week. These roads were coated with PennSuppress, a
paraffin mixture used last year with good results.
SUBDIVISIONS:
- Ellie Brown Subdivision Plan: A review letter was
received from the Township Engineer. The EAC recommends denial of the
waiver of Section 402.E.2 requiring stormwater management measures due
to the slopes on the property.
- Stephen Siana/Sheeder Mill Subdivision Plan, an
as-built road plan and one additional lot to a previously approved 16
lot subdivision plan on 84.2 acres. A review letter was received from
the Township Engineer. Based on the gross total site acreage figure of
84.28 acres from the approved plan, it is not possible to meet the
5-acre average lot size requirement with a subdivision of 17 lots, as
proposed; a zoning hearing will be necessary. The Declaration of
Covenants, Easements, Obligations and Restrictions of Sheeder Mill
Subdivision note #7 states "No lot shown on the Record Plan shall
be further subdivided at any time"; the document will need to be
amended. It appears that Lot #8 may be affected by the as-built road;
this property owner may be required to sign the owner affidavit and
subdivision acknowledgement.
- Matthews Run Subdivision Plan: Final Plan approval
was granted by the Board of Supervisors Friday, June 26, 1998.
Discussions are taking place regarding the conveyance of the trails to
the Township.
- Ewing Tract: Notification was received from TriState
Environmental Management Services, Inc. that a Phase 1 Environmental
Site Assessment will be conducted on the property.
