BOARD OF SUPERVISORS
MINUTES - June 8, 1998
The regular meeting of the Board of Supervisors,
held in the Township Building, was called to order at 7:40 p.m.
by Chairman Kenneth Miller; others in attendance were Supervisors
Zoe Perkins and Karl Brachwitz, Manager Allen Heist, and Solicitor
Allan Greenwood.
MINUTES
Unanimous approval was granted for minutes of May
1, 11, 14, 15, and 26 with a motion from Mr. Brachwitz and
a second from Mrs. Perkins.
REPORTS
- Treasurer - General
account balance, $370,357.71; state account balance, $97,894.93;
total, $468,252.64. Kimberton Sewer account balance, $10,060.98.
Road repair loan account balance, $28,228.48. St. Stephen's
Greene Water account balance, $1,499.78. St. Stephen's Greene
Sewer account balance, $12,442.82. Mr. Burnley reported that
the road repair loan should be paid off about 1 1/2 years early
since $201,000 of the total $400,000 loan has been repaid.
- Tax collection - Received from Berkheimer
Associates: Current real estate tax, $72,346.33; road repair
loan, $80,805.11; earned income tax, $61,073.21; total, $214,224.65.
- Building Inspector - No summary was
given; fees for inspections, reviews, etc. done in May were $2,816.80.
- Zoning Officer - 1 building inspection
was made and 20 building permits were reviewed, as well as the
ongoing zoning projects.
- Fire Company - Ludwigs Corner: 4
calls in West Vincent in May. Request was made by Ludwigs Corner
Fire Company for replacement of "FIREHOUSE AHEAD"
signs which had been located on Rt. 100. The Board agreed
to procure the signs and install them at Fire Company expense.
- Solicitor
- Worked on purchase
of the Evans farm for the future site of the Township building.
An executive session was announced for after this meeting.
- Continued
efforts to initiate the reconstruction of basin #2 at St. Stephen's
Greene.
- Planning Commission - May 21: New
member recommended - Jean Warrick; reviewed correspondence and
plans for Robinson, Ludwigs Corner Fire Company, Sheeder Mill,
2 Hankin, Pronsky, and Matthews Run plans for subdivision.
- Environmental Advisory Council - No
minutes were available yet from the June 1 meeting. Mrs. Perkins
reported that agenda items were similar to the Planning Commission's.
CORRESPONDENCE
- Rider's Fox Den - On June 5, notice
was received from attorneys for the owner of this property on
Rt. 100 near the S. Coventry Township line that he will attempt
to transfer the liquor license purchased with this property to
another township in Chester County. A request was made of the
Board that they send a written opinion that there is no other
suitable real estate in our Township available for the operation
of a restaurant with a liquor license at the approximate cost
of $100,000. After a short discussion, the Board authorized Manager
Heist to advise the attorneys that the Township is not responsible
for real estate values, therefore no opinion as requested can
be given.
SUBDIVISIONS / LAND DEVELOPMENT / ZONING
- Hankin - Mr. Jim
Fuller, representative of the Hankin Group, reported that the
Group has skimmed over the Draft Zoning Ordinance to present a
comparison of their plan with the Draft. In-depth review
of the Draft will be a huge task because three districts are involved:
Village Commercial, Village Residential, and R-2 Residential.
Mr. Fuller noted several areas in which there are differences
between the two, but was certain that the "feeling"
is consistent with the Draft. Mr. Fuller will send this information
to the Township in written form.
- Applications were received on Friday, June
5 for Conditional Use and a Zoning Ordinance Amendment,
with an overlay for dealing with development of very large lots
(300+ acres), which Hankin attorney Steven Aichele described as
a "tool which will allow the Township to proceed" and
which could be used in any part of the Township. Kate Damsgaard
reminded the Board that the Master Plan for Ludwigs Corner was
designed in an effort to get an integrated look for all
of Ludwigs Corner, of which the Hankin lands are just a part.
Mr. Aichele noted that public hearings regarding these applications
can be handled in two ways: 1) both applications together or
2) the zoning change application in conjunction with the proposed
Draft Ordinance, with the conditional use to follow. The Board
will attempt to decide by the next meeting which approach they
will take.
- St. Stephen's Greene Water
System - The Emergency Response
Plan and the Drought Contingency Plan as required by
the Chester County Health Department for community water systems,
were unanimously approved by the Board with the following changes:
1) rate schedule to be included that would show what Township
employees would be paid should they be called to answer an emergency
call, and 2) name listed for Township Engineer on both plans to
be changed from Gary J. Weaver P.E. to Thomas G. Kelso AICP.
The motion was made by Mr. Brachwitz and seconded by Mrs. Perkins.
- Mr. Miller questioned why the St. Stephen's Greene
water account balance was so low. Manager Heist indicated
that he would be making corrections in an attempt to level out
these balances. Most likely the water rates will go up and the
sewer rates will go down.
- Pronsky - A 23 day extension of review
time (to July 14, 1998) was unanimously approved with a motion
from Mrs. Perkins and a second from Mr. Brachwitz.
OLD BUSINESS
Road dust - Mrs.
Perkins reported receiving several calls from residents on gravel
roads requesting some relief from dust. Manager Heist has prepared
maps showing areas to be treated for dust control:
- Jaine Lane from Horseshoe Trail to Kanaveys
- Davis Lane from Horseshoe Trail to the top
of the hill
- Dewees Lane from Conestoga Road to Adelphia
Lane
- Black Horse Road - all
- St. Andrews Lane - all
These roads will be coated with Penn Suppress, a
parafin mixture used last year with good results, which cut road
maintenance expenses for those dirt roads involved by 2/3. This
mixture is rated ecologically safe. The cost is $3,500/mile.
Mr. Miller was concerned about the lack of metering when being
dispensed. The mixture is metered when being loaded, but there
is no way for the Township to know if those numbers are accurate.
Manager Heist will check into this. Attempts will be made to
arrange for Fetters to grade these roads immediately prior to
their being coated, which is the recommended approach.
NEW BUSINESS
EAC Chairperson
Pam Brown reported that at the June 1 meeting the EAC had recommended
asking the Board to have a letter sent to all trash haulers
in our Township regarding speeding on Township roads.
Several calls have been received and some have had personal experiences
with this problem. The Board authorized Manager Heist to write
this letter.
BILLS LIST
Mr. Brachwitz made a motion to approve the bills
listed on the June 8, 1998 list; it was seconded by Mrs. Perkins
and carried unanimously.
There being no further business, the meeting was
adjourned at 8:30 p.m., after which an executive session was held
regarding purchase of the Evans farm.
