Vice Chairman Kate Damsgaard called the meeting to order at 7:40 p.m. The following correspondence and reports were reviewed:
The West Vincent Township Zoning Ordinance and West Vincent Township Subdivision and Land Development Ordinance final drafts were distributed. A public hearing is scheduled for Monday, June 1 at 7 p.m. at the Ludwigs Corner Fire Company; subsequent hearings will be held Monday, June 15 and 29 if necessary.
Weekly Planning Commission work sessions in May
will be advertised; members plan to review the Subdivision Ordinance
draft, Zoning Ordinance Article XXIII Water Resource Protection,
and Section 2224 Towers and Antennas beginning with the May 7
work session.
A public hearing was held on Tuesday, March 31, 1998 to hear testimony on the validity challenge and curative amendment application filed by Michael and Janet Polay. The applicants allege the Township Zoning Ordinance is invalid because it is exclusionary with respect to the collection and removal of spring water for commercial purposes. The Board of Supervisors will render their decision by May 14, 1998 - date and time will be advertised.
Jeffrey Miller, Hopkins and Scott Inc., and Walter Pronsky,
applicant were present to review the Pronsky Preliminary
Subdivision Plan. The plan shows the 8.702 acre property
located on St. Matthews Road divided into three lots: Lot 1 -
2.076 acres with an existing house; Lot 2 - 4.6225 acres, which
Mr. Pronsky plans to build his home; and Lot 3 - 2.004 acres with
no development proposed. A 50' right of way for access and utilities
to Lot 1 and Lot 3 is owned and maintained by the owner of Lot
2. The gravel driveway will be paved. Adjacent property owner
Steve Siana requested screening/buffering trees and noted the
creation of a long accessway; Mr. Siana suggested access from
either the private drive (Thomas property) or Douglass Lane.
The plan has been sent out for review.
Paul Haldeman, Conservation Advisors, representing the Fraley
Family, reviewed the Fraley Farm Subdivision Plan.
The 47.612 acre farm located on Old Kimberton Road and Flint
Road is divided into five lots: three building lots of 5.132
acres, 3.876 acres, 2.848 acres; Lot 2 - 3.254 acres with an
existing house; and Lot 5 - 32.502 acres. A note will be added
regarding ownership and maintenance of the open space area. The
plan has been sent out for review.
Lisa DiAndrea, Medveczky Associates, representing Karen and James
Fasel, reviewed a sketch plan for the Fasel property,
1245 School House Lane. The conceptual plan is designed using
the Tier 3 development option for the R2 district; the 175' set
back requirement from the right-of-way of existing Township roads
will be reviewed by the Planning Commission. The 36.42 acre farm
is divided into ten residential lots; lot 10 is the existing farmstead,
lots 1 and 9 show on site water and sewer and the remaining lots
show on site well and sewerage pumped to one of two sewer areas.
The owners will consider deed restricting Lot 10 against further
subdivision. The property includes a PECO easement and a 100'
wide gas easement; Ms. DiAndrea will investigate relocating the
overhead electric lines.
Members reviewed the newly submitted Hankin Group Preliminary
Plan for a by-right subdivision of the 298 acre property
at Ludwigs Corner. The plan shows six office/warehouse industrial
lots, 140 residential lots and 176.393 acres of open space, on-lot
sewage for the industrial lots, community spray for the residential
lots and public water. A second plan for the tract, using a
village concept, will be submitted within three weeks.
Matthews Run final plan has been submitted; reviews
are incomplete.
Board liaison Zoe Perkins read from the April 13 Board of Supervisors minutes "Peter Rodgers asked whether the vacancies on the Planning Commission would be filled prior to hearings on the new ordinances. Although the Planning Commission can have seven members, they seem to work better with less but may be considering increasing again to seven members." The Planning Commission will consider making a recommendation to the Board regarding membership.
A revised Robert B. Kling Subdivision Plan was
submitted and reviewed by Vince Kling. There was a lengthy discussion
regarding the access to the proposed interior lots. Adjacent
property owner, Steve Siana, mentioned the Zoning Ordinance Section
1909, A & C requires all interior lots to be connected to
a road or street by a fee simple accessway and have road frontage.
Mr. Kling explained lot 1 has a fee simple accessway and the
remaining lots share the common driveway easement as permitted
by Section 606 L. 1 and 2 of the Subdivision and Land Development
Ordinance. The same applies to lots 5, 6 and 7. The Township
Engineer will be asked to review this issue.
A waiver from delineating wetlands is not requested since the
Township can require a delineation at the time of building permit
application. Note 7 states "should construction be contemplated
within 100' of worsham soils, wetlands shall be delineated in
the affected area at that time". Mr. Siana voiced his concerns
regarding runoff from lot 1 and the additional runoff created
by the common driveway, particularly in the area designated 15-25%
steep slopes. Vince Kling noted that each lot will be controlled
by a permanent stormwater management structure located on that
lot; the stormwater calculations show a recharge coefficient of
9.0. Final driveway alignment may be adjusted based on the individual
home design and field conditions and a grading plan will be submitted
at the time of driveway permit application. The driveway width
was changed to 12', turnouts were added, and note 28 was added
to the plan stating "all driveway construction shall comply
with all Township standards in effect at the time of construction".
Note 26 was modified to ask for a waiver from underground utilities
if the utility companies require above ground placement.
The applicant prefers underground utilities.
Motion by Wheeler Aman, seconded by Joan Michaelson, to recommend approval of the Robert Kling Subdivision Plan contingent upon the Township Engineer's review of the access to the interior lots and review of the driveway alignment in the steep slope area in regard to stormwater management. The applicant will comply with the Township Engineer's recommendations. The motion carried with Aman, Damsgaard and Michaelson voting in favor; Kling abstained.
The minutes from the March 19, 1998 meeting were unanimously approved with a motion from Vince Kling and second from Joan Michaelson. The meeting was adjourned at 10:25 p.m.
